【摘要】:就業(yè)歧視問題日益嚴重促使我國決策層和學界達成如下共識:我國應當盡快制定一部統(tǒng)一的《反就業(yè)歧視法》。面對形形色色的就業(yè)歧視,現(xiàn)有反就業(yè)歧視立法幾乎無能為力。不僅反就業(yè)歧視的實體法規(guī)定殘缺不全,而且反就業(yè)歧視的程序法規(guī)定形同虛設。綜觀世界反就業(yè)歧視立法經驗,我國即將制定的《反就業(yè)歧視法》應當著重解決如下基本問題:《反就業(yè)歧視法》的立法目的應體現(xiàn)多重價值;其適用范圍應該包含事業(yè)單位勞動者和國家公務員;我國應采取科學合理的就業(yè)歧視定義模式;設立統(tǒng)一的反就業(yè)歧視的專門機構;設計反就業(yè)歧視的司法救濟機制;建構就業(yè)歧視的法律責任制度。
[Abstract]:The problem of employment discrimination is becoming more and more serious in our country and the academic circles have reached a consensus as follows: our country should formulate a unified Anti-Employment Discrimination Law as soon as possible to face various forms of employment discrimination. The existing legislation against employment discrimination is almost powerless. Not only the provisions of substantive law against discrimination in employment are incomplete, but also the provisions of procedural law against discrimination in employment are virtually empty. A comprehensive review of the experience of the legislation against discrimination in employment in the world is given. The Anti-Employment Discrimination Law to be enacted in China should focus on solving the following basic problems: the legislative purpose of the Anti-Employment Discrimination Law should reflect the multi-value; The scope of application should include public institution workers and state civil servants; Our country should adopt the scientific and reasonable definition mode of employment discrimination; The establishment of a unified specialized body to combat discrimination in employment; Designing the judicial remedy mechanism against employment discrimination; Construct the legal liability system of employment discrimination.
