【摘要】： 煤炭是工業(yè)社會的主要能源,短期內(nèi)具有不可替代性。在我國,煤礦安全生產(chǎn)問題十分突出,礦難頻發(fā)。面對國內(nèi)嚴(yán)峻的煤礦安全生產(chǎn)形勢,國務(wù)院決定把國家安全生產(chǎn)監(jiān)督管理局升格為國家安全生產(chǎn)監(jiān)督管理總局,同時專設(shè)由總局管理的國家煤礦安全監(jiān)察局,提高監(jiān)察的權(quán)威性,強(qiáng)化煤礦安全監(jiān)察執(zhí)法。盡管煤礦安全行政執(zhí)法對于遏制和扭轉(zhuǎn)目前嚴(yán)重的煤礦安全生產(chǎn)形勢具有重大作用,然而,到目前為止,煤礦安全行政執(zhí)法的效果并不顯著,我國的煤礦安全生產(chǎn)形勢依然十分嚴(yán)峻、不容樂觀。社會各界紛紛就此建言獻(xiàn)策,希望能為扭轉(zhuǎn)目前嚴(yán)峻的煤礦安全生產(chǎn)形勢貢獻(xiàn)自己的綿薄之力。我國學(xué)界也對此問題作出了積極回應(yīng),進(jìn)行了不少非常有意義的探討。然而,此類學(xué)術(shù)探討或從行政管理學(xué)角度,或從社會學(xué)角度,亦或從政治學(xué)角度,其中鮮有從法學(xué)視角來探討者,而且法學(xué)方面的探討也多集中于民商法領(lǐng)域,有關(guān)煤礦安全行政監(jiān)管的行政法理論研究十分匿乏,又不太深入。這就需要行政法學(xué)界更多地研究這一問題,并積極地做出理論回應(yīng)。這也是本文可能的創(chuàng)新之處。
[Abstract]:Coal is the main energy of the industrial society, which can not be replaced in the short term. In our country, the problem of coal mine safety production is very prominent, and mine accidents occur frequently. In the face of the severe situation of coal mine safety production in China. The State Council has decided to upgrade the State Administration of production Safety Supervision and Administration to the State Administration of production Safety Supervision and Administration, and at the same time set up the State Coal Mine Safety Supervision Bureau, which is under the administration of the State Administration, to enhance the authority of supervision. Strengthen coal mine safety supervision and law enforcement. Although coal mine safety administrative law enforcement has a significant role in curbing and reversing the serious situation of coal mine production safety, however, so far. The effect of coal mine safety administrative law enforcement is not remarkable. The situation of coal mine safety production is still very severe, which is not optimistic. Hope to be able to reverse the grim situation of coal mine production safety contribution to their own modest force. Our academic circles also made a positive response to this problem, carried out a lot of very meaningful discussions. However. This kind of academic discussion either from the angle of administrative management, from the angle of sociology, or from the angle of political science, few of them are from the perspective of law, and the discussion of law also concentrates on the field of civil and commercial law. The theoretical study of administrative law on coal mine safety administrative supervision is very obscure and not too deep, which requires more research on this issue in the field of administrative law. And actively make a theoretical response. This is the possible innovation of this paper.
