【摘要】：立案是查辦貪污賄賂犯罪的開(kāi)始，也是查辦貪污賄賂犯罪的難題之一。在目前我國(guó)貪污賄賂犯罪立案程序中，存在諸多問(wèn)題。對(duì)立案條件和標(biāo)準(zhǔn)的把握也缺乏具體的法律法規(guī)。導(dǎo)致在司法實(shí)踐中不破不立、先破再立、錯(cuò)誤立案等現(xiàn)象時(shí)有發(fā)生。對(duì)于我國(guó)貪污賄賂犯罪立案問(wèn)題的研究成果也有不少，但大都是停留在設(shè)想階段，缺乏可操作性。 本文研究了現(xiàn)階段我國(guó)貪污賄賂犯罪立案的基本概念、特征、條件、標(biāo)準(zhǔn)、審查、決定、監(jiān)督和救濟(jì)。接著，，重點(diǎn)分析了目前我國(guó)貪污賄賂犯罪立案程序在立案審查、立案方式和立案監(jiān)督方面存在的問(wèn)題，提出了幾點(diǎn)建議。第一，建議嚴(yán)格把握貪污賄賂犯罪立案條件和標(biāo)準(zhǔn)，不能過(guò)嚴(yán)而放縱犯罪，不能過(guò)松而侵犯人權(quán)。要正確理解立案階段的證據(jù)標(biāo)準(zhǔn)，做好證據(jù)審查工作，為能否做出立案決定提供依據(jù)。第二，建議根據(jù)個(gè)案具體情況正確選擇立案方式。第三，建議建立和健全有效的貪污賄賂犯罪立案監(jiān)督機(jī)制和立案救濟(jì)機(jī)制。第四，建議嚴(yán)格區(qū)分初查和偵查程序，完善初查程序，保障人權(quán)。希望通過(guò)以上研究，能夠?qū)ξ覈?guó)貪污賄賂犯罪立案程序有一定的指導(dǎo)作用。
[Abstract]:Filing a case is the beginning of investigation of corruption and bribery crime, but also one of the difficult problems in investigating corruption and bribery crime. At present, there are many problems in the criminal procedure of corruption and bribery in our country. There is also a lack of specific laws and regulations to grasp the conditions and standards for filing a case. Causes in the judicial practice does not break not to stand, first to break and then to establish, wrong case and so on the phenomenon has occurred from time to time. There are a lot of research results on the problem of corruption and bribery in our country, but most of them remain in the stage of imagination and lack of maneuverability. This paper studies the basic concepts, characteristics, conditions, standards, reviews, decisions, supervision and remedies of corruption and bribery cases in China. Then, the paper analyzes the problems existing in the procedure of filing corruption and bribery in our country, and puts forward some suggestions. First, it is suggested that we should strictly grasp the conditions and standards of filing corruption and bribery crimes, and not indulge the crimes too strictly and violate human rights too loosely. It is necessary to correctly understand the standard of evidence at the stage of filing, and do well in the examination of evidence so as to provide the basis for making a decision on filing a case. Second, it is suggested that the case should be correctly selected according to the specific circumstances of the case. Thirdly, it is suggested to establish and perfect the effective supervision mechanism and remedy mechanism of corruption and bribery crimes. Fourth, we should strictly distinguish between initial investigation and investigation procedure, perfect initial investigation procedure and protect human rights. It is hoped that the above research will have a certain guiding effect on the procedure of filing corruption and bribery crimes in our country.
