【摘要】：審判機(jī)關(guān)無(wú)法獨(dú)立行使審判權(quán)是束縛我國(guó)行政訴訟發(fā)展的重要問(wèn)題，嚴(yán)重影響了司法機(jī)關(guān)對(duì)行政案件的公正、獨(dú)立審判。這一問(wèn)題的存在主要是由于我國(guó)的司法機(jī)關(guān)無(wú)法完全獨(dú)立于行政機(jī)關(guān)而存在，尤其是在人事和財(cái)政等重要事項(xiàng)中都要受到行政機(jī)關(guān)的干預(yù)，面對(duì)行政案件很難獨(dú)立地做出判決。對(duì)此，我國(guó)目前主要采取提級(jí)管轄和異地管轄的方式予以解決，但這兩種方法也有其不可克服的缺陷，運(yùn)用不當(dāng)?shù)脑捝踔習(xí)�成為行政干預(yù)司法的途徑。人民陪審員并不受黨政機(jī)關(guān)的干預(yù)，而且在西方國(guó)家，陪審制度一直扮演著約束當(dāng)權(quán)者與審判者的重要角色，廣泛的民眾參與賦予了司法活動(dòng)極高的民主性與公正性，而且，陪審員獨(dú)立于司法系統(tǒng)，不受司法系統(tǒng)的人事與財(cái)政干預(yù)，也就不會(huì)受到行政機(jī)關(guān)的影響，可以更加公正、獨(dú)立地參與審判活動(dòng)。陪審制度以及陪審員的此種特性剛好可以彌補(bǔ)行政訴訟缺乏獨(dú)立性的缺點(diǎn)，但要完美的應(yīng)用于行政訴訟中，我國(guó)的人民陪審制度還需要進(jìn)一步的完善，尤其要擴(kuò)大人民陪審員的來(lái)源，提高人民陪審員的參審積極性，改善人民陪審員的參審方式，使得人民陪審員能夠更好地運(yùn)用到行政訴訟中去。
[Abstract]:The inability of judicial organs to exercise judicial power independently is an important problem that restricts the development of administrative litigation in China, which seriously affects the justice and independent trial of administrative cases by judicial organs. The existence of this problem is mainly due to the fact that the judicial organs of our country cannot be completely independent of the administrative organs, especially in the important matters such as personnel and finance, which are subject to the intervention of the administrative organs, and it is difficult to make independent judgments in the face of administrative cases. At present, our country mainly adopts the way of promotion jurisdiction and different jurisdiction, but these two methods also have their insurmountable defects, if they are not used properly, they will even become the way of administrative intervention in the administration of justice. The people's assessors are not subject to the interference of the party and government organs. Moreover, in western countries, the jury system has always played an important role in restraining the authorities and the judges. Extensive popular participation has given the judicial activities a very high degree of democracy and impartiality. Jurors are independent of the judicial system, free from the personnel and financial interference of the judicial system, so that they are not affected by the administrative organs and can participate in the trial activities more impartially and independently. The jury system and the characteristics of jurors can make up for the lack of independence in administrative litigation, but to be applied perfectly in administrative proceedings, the people's jury system in our country needs to be further improved. In particular, it is necessary to expand the sources of the people's jurors, improve the enthusiasm of the people's jurors to participate in the trial, and improve the way of the people's assessors' trial, so that the people's jurors can be better applied to the administrative proceedings.
