【摘要】：正一、我國(guó)農(nóng)村土地信托流轉(zhuǎn)模式的探索人類文明得以持續(xù)發(fā)展的內(nèi)在原因之一是對(duì)財(cái)產(chǎn)轉(zhuǎn)移和財(cái)產(chǎn)管理進(jìn)行有效的制度設(shè)計(jì)。就財(cái)產(chǎn)轉(zhuǎn)移而言,我國(guó)法律已經(jīng)建立了買賣、贈(zèng)與和繼承等制度,并采用物權(quán)、代理、行紀(jì)、有限合伙等多項(xiàng)制度進(jìn)行財(cái)產(chǎn)管理。那么為什么還要引入信托制度?其原因在于信托制度具有極大的創(chuàng)新價(jià)值,它擁有橫跨資本、貨幣、產(chǎn)業(yè)市場(chǎng)的制度優(yōu)勢(shì),從而使其財(cái)產(chǎn)轉(zhuǎn)移與管理功能方面與傳統(tǒng)制度相比作用更加鮮明。~①隨著中國(guó)在世界經(jīng)濟(jì)地位的不斷鞏固,我國(guó)信托
[Abstract]:One of the internal reasons for the sustainable development of human civilization is the effective institutional design of property transfer and property management. As far as property transfer is concerned, the law of our country has established the sale and purchase. Such systems as gifts and inheritance, and the use of real right, agency, disciplinary, limited partnership and other systems of property management. So why the introduction of trust system? The reason is that the trust system has great innovative value. It has institutional advantages across the capital, currency, and industrial markets. Thus, the function of property transfer and management is more distinct than that of the traditional system. With the continuous consolidation of China's position in the world economy, the trust of our country has been strengthened.
