【摘要】：對(duì)合犯理論在我國(guó)尚未有系統(tǒng)的分析與研究，但與之相對(duì)應(yīng)的是，立法上不僅規(guī)定了具有對(duì)合性的諸多犯罪，而且在司法實(shí)踐中還有大量關(guān)于對(duì)合犯的疑難問(wèn)題亟待解決。對(duì)合犯理論研究程度與司法現(xiàn)狀的不協(xié)調(diào)，導(dǎo)致對(duì)合犯在司法實(shí)踐中存在諸多爭(zhēng)議。本文力圖以對(duì)合犯的整體性進(jìn)行研究，梳理并解釋對(duì)合犯在基礎(chǔ)理論、犯罪和刑罰論中出現(xiàn)的疑難問(wèn)題，以期能為司法實(shí)踐提供合理的認(rèn)定標(biāo)準(zhǔn)。 本文除了引言以外，總共分為五個(gè)部分，約5萬(wàn)字，主要內(nèi)容如下： 第一部分是對(duì)合犯基礎(chǔ)理論的探討，包括對(duì)合犯的概念、內(nèi)涵與外延。本文認(rèn)為，對(duì)合犯的概念應(yīng)當(dāng)堅(jiān)持“廣義說(shuō)”，指對(duì)應(yīng)的雙方主體實(shí)施了互為對(duì)向的行為而構(gòu)成的犯罪。對(duì)合犯的內(nèi)涵主要研究“對(duì)合主體”、“對(duì)合行為”、“互為對(duì)向的行為”、“犯罪結(jié)構(gòu)的依存關(guān)系”、“對(duì)合犯排斥被害關(guān)系”以及“對(duì)‘犯’的理解”等基本特征，以明確對(duì)合犯的成立條件。對(duì)合犯的外延將對(duì)合犯劃分為彼此同罪對(duì)合犯、彼此異罪對(duì)合犯和處罰一方對(duì)合犯，并對(duì)屬于三種對(duì)合犯類型的具體犯罪進(jìn)行歸納。 第二部分是對(duì)合犯與共同犯罪關(guān)系的研究，該部分以對(duì)合犯的行為性質(zhì)為基礎(chǔ)，從兩個(gè)方面來(lái)界定對(duì)合犯行為在共同犯罪中的定罪量刑：一是對(duì)合犯一方實(shí)施的實(shí)行行為本身又對(duì)另一方的犯罪起到教唆、幫助作用，由于該行為沒(méi)有超出自身犯罪構(gòu)成要件客觀方面行為的合理范圍，不再另行構(gòu)成共犯；二是對(duì)合犯一方同時(shí)實(shí)施了實(shí)行行為與對(duì)另一方犯罪的教唆、幫助行為，這兩個(gè)行為的性質(zhì)完全不同，應(yīng)當(dāng)分別認(rèn)定。 第三部分是第三方參與對(duì)合犯行為的分析，第三方參與的行為根據(jù)作用對(duì)象和定罪處罰的不同為標(biāo)準(zhǔn)進(jìn)行分類，并結(jié)合三種對(duì)合犯的類型分別確定第三方的刑事責(zé)任，主要探討介紹人在相關(guān)賄賂犯罪中實(shí)施居中撮合，牽線搭橋的行為，是按照介紹賄賂罪單獨(dú)定罪處罰還是以行、受賄罪的共犯進(jìn)行處罰，以厘清介紹賄賂罪與行、受賄罪共犯之間的關(guān)系。本文認(rèn)為，只要介紹行為實(shí)施完畢，并達(dá)到情節(jié)嚴(yán)重就構(gòu)成介紹賄賂罪，而不論所介紹的賄賂行為是否構(gòu)成犯罪，如果介紹行為同時(shí)構(gòu)成介紹賄賂罪與行、受賄罪共犯的，應(yīng)按照想象競(jìng)合犯從一重處罰。 第四部分提出了對(duì)合犯既遂的標(biāo)準(zhǔn)。本文認(rèn)為對(duì)合犯既遂的判定應(yīng)以自身犯罪構(gòu)成要件為標(biāo)準(zhǔn)，而非統(tǒng)一以雙方的對(duì)合行為都實(shí)施完畢才成立既遂。在對(duì)合犯中存在大量非法交易行為的犯罪，犯罪既遂的時(shí)間點(diǎn)應(yīng)當(dāng)以非法交易對(duì)象是否實(shí)際轉(zhuǎn)移到另一方為標(biāo)準(zhǔn)，而不論行為人是否因此獲取利益或者雙方交易行為是否實(shí)施完畢。此外，行賄罪與受賄罪兩罪之間根據(jù)各自的犯罪構(gòu)成要件也并非一定是同時(shí)達(dá)成既遂，需要分情況進(jìn)行具體認(rèn)定。 第五部分是對(duì)合犯自首的認(rèn)定。彼此同罪對(duì)合犯是共同犯罪，其中一方在自首時(shí)需要供述對(duì)方的犯罪行為。彼此異罪對(duì)合犯一方主體在自首時(shí)揭發(fā)同案另一方犯罪行為的，由于沒(méi)有超出如實(shí)供述的合理范圍，，只構(gòu)成自首不成立立功。處罰一方對(duì)合犯中犯罪一方自首時(shí)只需要供述自己的罪行即可。
[Abstract]:This paper tries to study , comb and explain the problems in the theory of basic theory , crime and punishment , with a view to providing reasonable criteria for judicial practice .

In addition to the introduction , this paper is divided into five parts , about 50,000 words , the main contents are as follows :

The first part is the discussion of the basic theory of the crime , including the concept , the connotation and the extension of the crime .

The second part is the study of the relationship between the crime and the common crime , which is based on the nature of the behavior of the crime , and defines the punishment for the crime of the joint crime from the two aspects : one is the commission of the crime committed by one party itself and the other party ' s crime , and the help function , since the act does not exceed the reasonable scope of the objective aspect of the constitutive requirements of the crime , no longer constitutes a accomplice ;
The second is to commit the crime to the other party at the same time and to abetate and help the other party ' s crimes . The nature of the two acts is completely different and should be determined separately .

The third part is the third party ' s participation in the analysis of the behavior of the party , the behavior of the third party ' s participation is classified according to the difference of the action object and the conviction punishment , and the criminal responsibility of the third party is determined according to the types of the three kinds of crimes .

In the fourth part , the author puts forward the criteria of attempted crime . In this paper , it is believed that the author ' s determination should be based on the constitutive requirements of its own crime , but not the unity of the two parties . In addition , the time point of the attempted crime should be transferred to the other party by the non - illegal transaction object , regardless of whether the perpetrator obtained the benefit or whether the transaction behavior of both parties is completed .

The fifth part is the determination of the self - surrender of the joint offense . One of the other crimes is the common crime , one of which needs to supply the other party ' s criminal behavior at the time of surrender . One of the other crimes against the other party ' s criminal behavior during the surrender of the crime . Because there is no reasonable scope of the facts , only the self - first is not established . The punishing party only needs to supply his own crimes when the one who commits the crime of the crime is surrendered .
