【摘要】：隨著網(wǎng)絡(luò)社會(huì)的不斷成熟，網(wǎng)絡(luò)為公民行政問(wèn)責(zé)提供了新的實(shí)現(xiàn)形式即網(wǎng)絡(luò)問(wèn)責(zé)。網(wǎng)絡(luò)問(wèn)責(zé)又可稱為網(wǎng)絡(luò)公民行政問(wèn)責(zé)，是公民以網(wǎng)絡(luò)為平臺(tái)，通過(guò)批評(píng)、建議、檢舉、揭發(fā)等途徑，針對(duì)政府及其行政人員的失職行為進(jìn)行質(zhì)詢并要求承擔(dān)責(zé)任的一種活動(dòng)。網(wǎng)絡(luò)問(wèn)責(zé)是由異體問(wèn)責(zé)展開(kāi)的對(duì)公權(quán)力的行政問(wèn)責(zé)，網(wǎng)絡(luò)問(wèn)責(zé)具有匿名性、高效性、大眾性的特征。本文通過(guò)對(duì)網(wǎng)絡(luò)問(wèn)責(zé)在我國(guó)的理論基礎(chǔ)和網(wǎng)絡(luò)問(wèn)責(zé)的主要問(wèn)題、法律規(guī)制的必要性進(jìn)行闡釋，推導(dǎo)出我國(guó)網(wǎng)絡(luò)問(wèn)責(zé)機(jī)制良性發(fā)展的根本出路，即實(shí)現(xiàn)網(wǎng)絡(luò)問(wèn)責(zé)法律規(guī)制。 近年來(lái)網(wǎng)絡(luò)問(wèn)責(zé)運(yùn)行已經(jīng)出現(xiàn)了一些問(wèn)題，主要表現(xiàn)為問(wèn)責(zé)啟動(dòng)時(shí)網(wǎng)絡(luò)問(wèn)責(zé)法律界限模糊，使得網(wǎng)絡(luò)問(wèn)責(zé)法律地位、問(wèn)責(zé)范圍沒(méi)有明確；問(wèn)責(zé)過(guò)程中網(wǎng)絡(luò)問(wèn)責(zé)主體素質(zhì)不均，網(wǎng)絡(luò)問(wèn)責(zé)信息真實(shí)存疑，使得侵犯被問(wèn)責(zé)對(duì)象權(quán)益的事件頻發(fā)；問(wèn)責(zé)深入時(shí)，網(wǎng)絡(luò)問(wèn)責(zé)對(duì)接機(jī)制缺乏，使得網(wǎng)絡(luò)問(wèn)責(zé)結(jié)果難以保障。可是網(wǎng)絡(luò)問(wèn)責(zé)在監(jiān)督行政權(quán)力、保障公民權(quán)利、化解社會(huì)矛盾等方面起著重要的作用。運(yùn)用法律手段對(duì)網(wǎng)絡(luò)問(wèn)責(zé)進(jìn)行規(guī)制是最為合理的選擇，以此解決網(wǎng)絡(luò)問(wèn)責(zé)運(yùn)行中出現(xiàn)的問(wèn)題，發(fā)揮網(wǎng)絡(luò)問(wèn)責(zé)強(qiáng)而有力的功能。這樣才是對(duì)我國(guó)行政問(wèn)責(zé)實(shí)踐中現(xiàn)實(shí)需要的積極回應(yīng)，才是解決我國(guó)行政問(wèn)責(zé)困境的必然選擇。 在已有的行政理論基礎(chǔ)之上，聯(lián)系實(shí)際，可以尋找到建立網(wǎng)絡(luò)問(wèn)責(zé)法律規(guī)制的基礎(chǔ)理論，包括網(wǎng)絡(luò)問(wèn)責(zé)的概念、網(wǎng)絡(luò)問(wèn)責(zé)的特點(diǎn)，網(wǎng)絡(luò)問(wèn)責(zé)動(dòng)態(tài)運(yùn)行模式，結(jié)合網(wǎng)絡(luò)問(wèn)責(zé)實(shí)踐中存在的問(wèn)題，，論證網(wǎng)絡(luò)問(wèn)責(zé)法律規(guī)制的必要性，在此基礎(chǔ)上對(duì)網(wǎng)絡(luò)問(wèn)責(zé)進(jìn)行深入研究，找到網(wǎng)絡(luò)問(wèn)責(zé)中需要進(jìn)行法律規(guī)制的四個(gè)方面：劃分權(quán)責(zé)界限，實(shí)現(xiàn)信息公開(kāi)，協(xié)調(diào)權(quán)力沖突，構(gòu)建對(duì)接機(jī)制。
[Abstract]:With the development of the network society, the network provides a new way to realize the citizen's administrative accountability, that is, the network accountability, which can be called the network citizen's administrative accountability, and it is the citizen who takes the network as the platform, through the criticism, the suggestion, the prosecution. It is an activity to question the government and its administrative personnel for their dereliction of duty and to assume responsibility. Network accountability is the administrative accountability of public power, which is carried out by heterogeneous accountability, which is anonymous and efficient. This paper explains the theoretical basis of network accountability in China, the main problems of network accountability, the necessity of legal regulation, and deduces the fundamental way out for the benign development of network accountability mechanism in China. That is to achieve the legal regulation of network accountability. In recent years, there have been some problems in the operation of network accountability, mainly manifested in the blurring of the legal boundaries of network accountability when the accountability starts, which makes the legal status of network accountability and the scope of accountability unclear; the quality of network accountability subjects is uneven in the process of accountability. The network accountability information is true and doubtful, which makes the violation of the rights and interests of the accountable object frequent; when the accountability goes deep, the network accountability docking mechanism is lacking, which makes the network accountability result difficult to guarantee. However, the network accountability is to supervise the administrative power. It is the most reasonable choice to use legal means to regulate the network accountability in order to solve the problems in the operation of network accountability, which plays an important role in protecting citizens' rights and resolving social contradictions. Giving full play to the strong and powerful function of network accountability is the positive response to the actual needs in the practice of administrative accountability in our country and the inevitable choice to solve the dilemma of administrative accountability in our country. On the basis of the existing administrative theory and practice, we can find the basic theory of establishing the legal regulation of network accountability, including the concept of network accountability, the characteristics of network accountability, the dynamic operation mode of network accountability. Combined with the problems existing in the practice of network accountability, this paper demonstrates the necessity of the legal regulation of network accountability, and on this basis makes a thorough study of network accountability, and finds out four aspects of legal regulation in network accountability: dividing the limits of power and responsibility. Realize information publicity, coordinate power conflict, construct docking mechanism.
