【摘要】：受教育權(quán)是指公民依法享有的要求國(guó)家積極提供均等的受教育條件和機(jī)會(huì)，并通過(guò)學(xué)習(xí)使人的德智體等全面發(fā)展，，以獲得平等的生存和發(fā)展機(jī)會(huì)的基本權(quán)利。平等權(quán)作為一種原理性的、概括性的基本權(quán)利深刻的影響著受教育權(quán)，使受教育權(quán)在現(xiàn)代社會(huì)中必然體現(xiàn)出平等的特性。因此，平等受教育權(quán)是指受教育者的受教育機(jī)會(huì)的平等和受教育待遇的平等．然而在現(xiàn)實(shí)社會(huì)中，并非每個(gè)公民都能充分實(shí)現(xiàn)作為憲法基本權(quán)利的平等受教育權(quán)，其中，農(nóng)民工隨遷子女最難實(shí)現(xiàn)其平等受教育權(quán)已經(jīng)成為整個(gè)社會(huì)的焦點(diǎn)和熱點(diǎn)。 本文一共分為五個(gè)部分，筆者以受教育權(quán)為出發(fā)點(diǎn)，在分析平等作為受教育權(quán)的基本特征的同時(shí)與我國(guó)農(nóng)民工隨遷子女當(dāng)前的處境相聯(lián)系，進(jìn)而深入探討我國(guó)農(nóng)民工隨遷子女平等受教育權(quán)的現(xiàn)狀，找到其中的成績(jī)與不足。在發(fā)現(xiàn)問(wèn)題的同時(shí)通過(guò)對(duì)于現(xiàn)狀的分析找到制約其平等受教育權(quán)難以實(shí)現(xiàn)的原因，深入分析每個(gè)原因的形成與發(fā)展，抓住主要矛盾。同時(shí)借鑒國(guó)外一些國(guó)家針對(duì)流動(dòng)人口所實(shí)施的各項(xiàng)法律措施與對(duì)策，從我國(guó)的實(shí)際出發(fā)，進(jìn)行大膽的設(shè)想，通過(guò)立法、執(zhí)法、司法等手段維護(hù)農(nóng)民工隨遷子女的平等受教育權(quán)。
[Abstract]:The right to education means that citizens are required by law to actively provide equal conditions and opportunities for education, and to make people's moral, intellectual, physical and other all-round development through study. The right to equality, as a fundamental and general right, has a profound impact on the right to education, which is bound to embody equality in modern society. The equal right to education refers to the equality of educational opportunities and treatment of educatees. However, in reality, not every citizen can fully realize the equal right to education as a fundamental constitutional right, among which, It is the most difficult for migrant workers' children to realize their equal right to education, which has become the focus and hot spot of the whole society. This paper is divided into five parts. The author takes the right to education as the starting point and analyzes the basic characteristics of equality as the right to education, which is connected with the current situation of migrant workers' children in our country. Furthermore, the paper probes into the present situation of the equal right to education for the children of migrant workers following migration in our country, and finds out the achievements and shortcomings. At the same time, through the analysis of the present situation, it finds out the reasons that restrict the realization of the equal right to education. Deeply analyze the formation and development of each cause, grasp the principal contradiction. At the same time, draw lessons from the various legal measures and countermeasures implemented by some foreign countries against the floating population, proceed from the reality of our country, carry out bold ideas, pass legislation, enforce the law, Judicial means and other means to protect migrant workers with the children of the equal right to education.
