【摘要】：比例原則已經(jīng)被我國(guó)的一些行政法學(xué)者奉為行政法的基本原則。但學(xué)術(shù)界對(duì)于比例原則如何在行政立法中的運(yùn)用，，如何運(yùn)用比例原則進(jìn)行司法審查，卻少有系統(tǒng)論述。我國(guó)對(duì)行政立法的審查主要是合法性審查，排除了合理性審查。然而在現(xiàn)實(shí)中，由于審查程序的缺失，合法性審查的設(shè)置猶如空中樓閣。而行政立法雖然不直接對(duì)行政相對(duì)人發(fā)生作用，卻以其適用對(duì)象的廣泛性與適用效力的持續(xù)性，對(duì)行政相對(duì)人的權(quán)利存在潛在的巨大影響。而比例原則在行政立法中的適用及在司法審查中的適用，一方面能夠使所立之法更具科學(xué)性，另一方面，也使所立之法能夠獲得法院的理解而更好地得以適用。故系統(tǒng)的討論行政立法中比例原則的適用與司法審查，具有重要的理論與實(shí)踐的意義。
[Abstract]:The principle of proportionality has been regarded by some administrative law scholars as the basic principle of administrative law. However, there is little systematic discussion on how to apply the principle of proportion in administrative legislation and how to apply the principle of proportionality to judicial review. The examination of administrative legislation in our country is mainly the examination of legality, excluding the examination of rationality. However, in reality, due to the lack of review procedures, legitimacy review is like a castle in the air. Although the administrative legislation does not directly affect the administrative counterpart, it has a potential great impact on the rights of the administrative counterpart because of the universality of the applicable object and the continuity of the applicable effect. On the one hand, the application of the principle of proportionality in administrative legislation and in judicial review can make the law more scientific, on the other hand, the law can be understood by the court and applied better. Therefore, it is of great theoretical and practical significance to systematically discuss the application of the principle of proportionality and judicial review in administrative legislation.
