【摘要】：高等學校法律援助制度是國家法治文明發(fā)展到一定階段的產物,它是高等學校教育發(fā)展改革的重要組成部分,是政府法律援助制度的有效補充,有利于推進依法治校,改革法學教育,彰顯人權價值,實現(xiàn)精準援助,捍衛(wèi)社會公平。自1992年武漢大學成立社會弱者權利保護中心以來,依托高校,學院以及高校間聯(lián)合成立的學生法律援助機構如雨后春筍般出現(xiàn)。2001年《司法部關于進一步加強法律援助工作的意見》的頒布施行以及2003年《法律援助條例》的出臺,國家以明確表示支持和鼓勵的態(tài)度,為高等院校建立法律援助機構提供了明確的法律依據(jù)。但截止目前,國家都沒有統(tǒng)籌制定統(tǒng)一的高校法律援助制度來指導高校法律援助機構開展具體工作,各高校的法律援助都還尚處于自我探索和相互借鑒的階段,針對高校法律援機構開展法律援助的專項制度的探索研究,更屈指可數(shù)。本文立足于高等學校法律援助機構,運用文獻計量分析、實踐調研、案例分析以及比較研究法,追根溯源從國內外法律援助制度研究入手,進而對高校法律援助制度的立法現(xiàn)狀和實施現(xiàn)狀進行剖析,并通過明確高校法律援助制度的研究范圍,對高校法律援助制度的相關概念和涉及的主體關系進行闡釋,梳理其內在的法理和典型的高校法律援助模式,為建立公平公正的高校法律援助制度提供前提基礎。爾后,在公平視域下,深度挖掘法律制度本身以公平為基石的“人權,民主,安全,秩序”等價值,立足于高等學校,法律援助人員以及受援人員三大主體,對高等學校法律援助制度的內隱和外顯價值進行分層剖析,展現(xiàn)本文研究的價值和意義。在此基礎上,為彰顯社會公平,秉承“人文關懷、效益、協(xié)同、全面監(jiān)督”的原則,從高等學校法律援助的機構和人員,設置標準,法律援助的具體實施三大方面對高等學校法律援助制度進行具體構建,提出“統(tǒng)一受理,分級審查,指派結合,權責相當”的法律援助運行模式,落實法律援助案件項目化以及法律援助服務轉換制,通過運用新媒體技術承接辦理和備案梳理相關案件事實,彰顯援助成果等具體的解決措施,并在與社會法律援助的銜接中,構建符合高校特色的普適化的法律援助制度,以保障社會公平正義。
[Abstract]:The legal aid system of colleges and universities is the product of the development of the civilization of the rule of law in the country to a certain stage. It is an important part of the educational development reform in colleges and universities, and an effective supplement to the legal aid system of the government, which is conducive to promoting the administration of schools according to law. Reform legal education, highlight the value of human rights, achieve precision assistance, and safeguard social justice. Since the establishment of the Center for the Protection of the Rights of the Social weak in Wuhan University in 1992, it has relied on colleges and universities. Colleges and student legal aid institutions jointly established among colleges and universities have sprung up. The Ministry of Justice's opinions on further strengthening legal Aid were promulgated in 2001 and the legal Aid regulations were introduced in 2003. The state has provided clear legal basis for the establishment of legal aid institutions in colleges and universities with a clear attitude of support and encouragement. However, up to now, the country has not formulated a unified legal aid system in colleges and universities to guide the institutions of legal aid in colleges and universities to carry out specific work, and the legal aid of each university is still in the stage of self-exploration and mutual reference. The research on the special system of legal aid in colleges and universities is even more rare. Based on the institutions of legal aid in colleges and universities, this paper uses bibliometric analysis, practical investigation, case analysis and comparative research to trace back to the source of the legal aid system at home and abroad. Then it analyzes the current legislative situation and implementation of the legal aid system in colleges and universities, and explains the related concepts and the relationship between the subjects involved in the legal aid system of colleges and universities by clarifying the research scope of the legal aid system in colleges and universities. Combing its inherent legal theory and typical legal aid model in colleges and universities, it provides a prerequisite for the establishment of a fair and just legal aid system in colleges and universities. Later, from the perspective of equity, the legal system deeply excavated the value of "human rights, democracy, security and order", which is the cornerstone of the legal system itself, and was based on the three major subjects of higher education, legal aid workers and recipients. This paper analyzes the implicit and explicit value of the legal aid system in colleges and universities, and shows the value and significance of this study. On this basis, in order to highlight social equity, uphold the principle of "humanistic care, efficiency, coordination, and overall supervision", set standards from institutions and personnel of legal aid in institutions of higher learning, The implementation of legal aid in three aspects of the specific construction of the legal aid system in institutions of higher learning, the proposed "unified acceptance, grading review, assignment combined, equal powers and responsibilities" of legal aid operation model, The implementation of the legal aid case project and legal aid service conversion system, through the use of new media technology to undertake the processing and filing of relevant cases, highlight the results of the assistance and other specific solutions, and in the link with the social legal aid, To establish a universal legal aid system in accordance with the characteristics of colleges and universities in order to ensure social fairness and justice.
