網(wǎng)絡(luò)輿論的行政法規(guī)制研究

【摘要】:隨著網(wǎng)絡(luò)技術(shù)、移動終端技術(shù)的飛速發(fā)展,網(wǎng)絡(luò)成為人們獲取信息、交流思想、表達看法的一個平臺,網(wǎng)絡(luò)輿論也成為一種新的輿論方式,方興未艾。作為輿論在網(wǎng)絡(luò)平臺的延伸,網(wǎng)絡(luò)輿論廣泛的介入到人們的生活,對人們的生活方式、生活狀態(tài)、乃至思維方式都產(chǎn)生了舉足輕重的影響。然而,近年來發(fā)生的一系列網(wǎng)絡(luò)事件,讓我們深刻體會到了網(wǎng)絡(luò)輿論同樣是一把“雙刃劍”,需要我們理性、客觀的審視網(wǎng)絡(luò)輿論的利弊,對網(wǎng)絡(luò)輿論進行合理有效的規(guī)制。 本文擬對網(wǎng)絡(luò)輿論這一特殊輿論方式進行研究,探討其發(fā)展現(xiàn)狀以及存在的問題,分析各種規(guī)制方式對網(wǎng)絡(luò)輿論的效果,探討行政法規(guī)制對于網(wǎng)絡(luò)輿論的必要性,列舉出有關(guān)網(wǎng)絡(luò)輿論的法律法規(guī)文件,并對其進行科學的分析。針對完善網(wǎng)絡(luò)輿論的行政法規(guī)制,對建設(shè)更加高效、有序的網(wǎng)絡(luò)輿論平臺提出相應(yīng)的觀點和建議。 第一部分,從科技手段、行業(yè)自律手段、公民教育手段這三種最常用的規(guī)制手段入手,提出網(wǎng)絡(luò)輿論需要法律規(guī)制的論點,通過分析,重點突出行政法手段對網(wǎng)絡(luò)輿論進行規(guī)制的必要性。 第二部分,通過列舉針對網(wǎng)絡(luò)輿論的法律條文,統(tǒng)計各個位階的法律文件,突出行政法部門所占的重要地位,,總結(jié)出現(xiàn)階段我國法律法規(guī)對網(wǎng)絡(luò)輿論進行規(guī)制的特點和不足,結(jié)合案例對網(wǎng)絡(luò)輿論的法律規(guī)制現(xiàn)實效果進行分析。 第三部分,對如何構(gòu)建網(wǎng)絡(luò)輿論的行政法規(guī)制體系進行探討。根據(jù)第二部分對規(guī)制網(wǎng)絡(luò)輿論的法律文件的分析,發(fā)表對完善網(wǎng)絡(luò)輿論的行政法規(guī)制的總體看法,從目前的實際情況出發(fā),提出旨在完善網(wǎng)絡(luò)輿論行政法規(guī)制的若干建議。
[Abstract]:With the rapid development of network technology and mobile terminal technology, network has become a platform for people to obtain information, exchange ideas and express their views. Network public opinion has also become a new way of public opinion, which is in the ascendant. As the extension of the public opinion in the network platform, the wide involvement of the network public opinion in people's lives, people's life style, life state, and even the mode of thinking has a decisive impact. However, a series of network events in recent years have made us realize that network public opinion is also a "double-edged sword", which requires us to examine the advantages and disadvantages of network public opinion rationally and objectively, and to regulate the network public opinion reasonably and effectively. This article intends to study the network public opinion as a special public opinion mode, discusses its development status and existing problems, analyzes the effects of various regulation modes on the network public opinion, and discusses the necessity of administrative regulation system for the network public opinion. Enumerates the relevant network public opinion law and regulation document, and carries on the scientific analysis to it. In view of perfecting the administrative regulation system of network public opinion, this paper puts forward the corresponding views and suggestions to build a more efficient and orderly network public opinion platform. The first part, starting with the three most commonly used means of regulation, scientific and technological means, industry self-discipline means, and civic education means, puts forward the argument that the network public opinion needs legal regulation, and through the analysis, The emphasis is on the necessity of regulating the network public opinion by means of administrative law. The second part, through enumerating the legal provisions aimed at the network public opinion, counting the legal documents of each rank, highlighting the important position occupied by the administrative law department, summarizing the characteristics and shortcomings of the regulation of the network public opinion by the laws and regulations in the emerging stage of our country. Combine the case to analyze the actual effect of the legal regulation of the network public opinion. The third part discusses how to construct the system of administrative laws and regulations of network public opinion. According to the analysis of the legal documents regulating the network public opinion in the second part, the author publishes the general views on the perfection of the administrative regulation system of the network public opinion, and puts forward some suggestions aimed at perfecting the administrative regulation system of the network public opinion according to the actual situation at present.
