【摘要】：當(dāng)今社會(huì)醫(yī)患關(guān)系緊張,醫(yī)鬧事件不斷,究其原因是患者權(quán)利立法存在諸多問題。實(shí)踐問題反映了立法問題,而立法問題折射出理論上對(duì)醫(yī)患關(guān)系的法律性質(zhì)、醫(yī)療行為法律性質(zhì)、患者權(quán)利的定義、患者權(quán)利救濟(jì)以及構(gòu)建患者權(quán)利體系的討論不足。要解決實(shí)踐問題,必先完善立法,欲解決立法問題必先討論理論問題。從醫(yī)患雙方的法律關(guān)系入手,確定醫(yī)患關(guān)系的法律性質(zhì),分析醫(yī)患關(guān)系中主體、客體,以及其內(nèi)容中的權(quán)利部分。若要保護(hù)患者權(quán)利,應(yīng)當(dāng)首先在理論上為患者權(quán)利下定義,在此基礎(chǔ)上建構(gòu)患者權(quán)利保護(hù)體系,構(gòu)建"醫(yī)方義務(wù)——患者權(quán)利"立法模式,為立法提供有力的參考。
[Abstract]:Nowadays, the relationship between doctors and patients is tense and medical incidents continue. The reason is that there are many problems in the legislation of patients' rights. The practical problems reflect the legislative problems, while the legislative problems reflect the lack of theoretical discussion on the legal nature of doctor-patient relationship, the legal nature of medical behavior, the definition of patients' rights, the relief of patients' rights and the construction of patient rights system. In order to solve the practical problem, we must first perfect the legislation, and if we want to solve the legislative problem, we must discuss the theoretical problem first. Starting with the legal relationship between doctors and patients, this paper determines the legal nature of the doctor-patient relationship, and analyzes the subject, object and the right part of the doctor-patient relationship. In order to protect the rights of patients, we should first define the rights of patients in theory, construct the protection system of patients' rights, and construct the legislative model of "medical obligations-patients' rights", so as to provide a powerful reference for legislation.
