監(jiān)察體制改革的憲法學(xué)思考

【摘要】:改革現(xiàn)有的監(jiān)察制度是政治體制改革的重要組成部分。從憲法層面來看監(jiān)察體制改革尚有若干重大理論問題亟待澄清,如行政監(jiān)察上升為國家監(jiān)察之后的憲法定位,監(jiān)察委員會在人民代表大會制度中的地位,監(jiān)察權(quán)在司法權(quán)力體系中的作用及定位,對監(jiān)察權(quán)監(jiān)督制約機(jī)制的探索,憲法修改與監(jiān)察體制改革合憲性的關(guān)聯(lián)等。對以上理論問題的不同解答直接影響監(jiān)察體制改革的價(jià)值追求和制度構(gòu)建,對未來的監(jiān)察效果也會產(chǎn)生深遠(yuǎn)影響。因此,試點(diǎn)期間必須未雨綢繆,在厘清理論難題的基礎(chǔ)上合理建構(gòu)對應(yīng)的監(jiān)察制度,如承認(rèn)監(jiān)察權(quán)的獨(dú)立屬性;完善選任機(jī)制和匯報(bào)制度;適時(shí)賦予監(jiān)察機(jī)關(guān)偵查權(quán),提升其在司法體系中的地位;借鑒廉政公署的監(jiān)督制約模式,構(gòu)建獨(dú)立的人民監(jiān)察員制度;以監(jiān)察體制改革為修憲契機(jī),審慎確定修憲內(nèi)容等。
[Abstract]:Reforming the existing supervision system is an important part of the reform of the political system. From the constitutional point of view, there are still a number of important theoretical issues in the reform of the supervision system that need to be clarified, such as the constitutional position of the administrative supervision after the rise to the national supervision, and the position of the supervisory committee in the people's Congress system. The function and orientation of supervision power in judicial power system, the exploration of supervision and restriction mechanism of supervision power, the relationship between constitutional amendment and constitutional reform of supervision system, etc. The different answers to the above theoretical problems directly affect the value pursuit and system construction of the reform of the supervision system, and will also have a profound impact on the supervision effect in the future. Therefore, during the pilot period, we must make good plans in advance, reasonably construct the corresponding supervision system on the basis of clarifying the theoretical problems, such as recognizing the independent attribute of the supervision power, perfecting the selection and appointment mechanism and the reporting system. In due course, the supervisory organs should be given the power to investigate and enhance their position in the judicial system; the independent people's ombudsman system should be constructed by drawing lessons from the supervision and restriction mode of the Independent Commission against Corruption (ICAC); and the contents of the constitutional amendment should be carefully determined with the reform of the supervisory system as an opportunity to amend the constitution.
