省直管縣體制下縣級政府的監(jiān)督與問責機制研究

【摘要】:縣級政府在我國的行政體制中處于中間層次,向上承接市政府,向下領導鄉(xiāng)政府,與國家經濟社會的發(fā)展緊密相連,縣級政府的行政權力也是中國政治架構中的關鍵。隨著省直管縣體制改革的逐步推進,縣級政府一方面很大程度的擴大了自主管理權限,不僅在人力、物力、財力等方面享受更加充足的資源,還可以根據自身的現狀,在不違背國家政策的前提下,自主的規(guī)劃發(fā)展方向,制定發(fā)展戰(zhàn)略創(chuàng)建多元化的具有自身特色的經濟發(fā)展模式。另一方面,縣級政府的自主化在擴大的的同時,市級政府對縣級政府的管理和制約就會放松,在某種程度上甚至會減少到不監(jiān)督。市級政府的這種狀況,就造成省級政府的管理幅度成倍擴大,管理幅度的擴大會影響省級政府的適應能力,它需要過渡和適應。所以建立對縣級政府的監(jiān)督和問責機制同樣需要時間來完成。而且,由于監(jiān)督問責機制的不健全,無法進行問責和追究,進一步助長了權力的腐敗。因此,上級政府如何運用正確、合理、科學的監(jiān)督方式對縣級政府進行有效地監(jiān)督和問責,成為省直管縣體制改革的中面臨的最大難題。本文基于組織結構扁平化理論、責任政府理論、委托代理理論和權力的監(jiān)督與制約理論基礎,闡述了省直管縣體制下省級政府和縣級政府的權責配置的變化,并在此基礎上,全面分析了省直管縣體制下縣級政府的監(jiān)管風險,即縣級政府權力急速擴張的風險、省級政府監(jiān)督難度增大的風險和上級政府問責力度不夠的風險。根據這些對風險進行成因分析,提出了完善省直管縣體制下縣級政府監(jiān)督與問責機制的對策,即建立省直管縣體制下縣級政府規(guī)范機制、建立省直管縣體制下縣級政府監(jiān)督機制和省直管縣體制下縣級政府問責機制。本文的目的是通過探討省直管縣下縣級政府的監(jiān)督風險,來構建一個全面、系統的縣級政府監(jiān)督體系,從而更好的實現縣級政府的良好發(fā)展,使省直管縣體制改革更加科學合理的推行。
[Abstract]:The county-level government is in the middle level in the administrative system of our country, undertakes the municipal government upward, leads the township government down, and is closely related to the development of the national economy and society. The administrative power of the county-level government is also the key in the political structure of China. With the gradual progress of the reform of the provincial directly administered county system, on the one hand, the county government has greatly expanded the authority of independent management, not only in terms of human, material, financial and other aspects to enjoy more adequate resources, but also according to its own current situation. On the premise of not violating the national policy, we should plan the development direction independently and formulate the development strategy to create a diversified economic development model with its own characteristics. On the other hand, with the expansion of the autonomy of the county-level government, the management and restriction of the municipal government to the county-level government will be relaxed, and to some extent, it will even be reduced to unsupervised. This situation of the municipal government leads to the doubling of the management range of the provincial government, the expansion of the management range affects the adaptability of the provincial government, it needs to transition and adapt. Therefore, it also takes time to establish the supervision and accountability mechanism of the county-level government. Moreover, the lack of accountability and accountability mechanisms further contributes to the corruption of power. Therefore, how to use the correct, reasonable and scientific supervision method to effectively supervise and hold the county government accountable has become the biggest problem in the system reform of the county directly managed by the provincial government. Based on the flattening theory of organizational structure, the theory of responsible government, the theory of principal-agent and the theoretical basis of supervision and restriction of power, this paper expounds the changes of the allocation of powers and responsibilities of provincial government and county-level government under the provincial and county-level system, and on this basis, This paper comprehensively analyzes the regulatory risks of the county-level government under the provincial directly administered county system, that is, the risk of the rapid expansion of the power of the county-level government, the risk of the increased difficulty of provincial government supervision and the risk of insufficient accountability of the higher government. According to the analysis of the causes of the risk, this paper puts forward some countermeasures for perfecting the supervision and accountability mechanism of the county-level government under the provincial directly administered county system, that is, to establish the normative mechanism of the county-level government under the provincial-directly administered county system. Establish the supervision mechanism of the county government under the provincial directly administered county system and the accountability mechanism of the county government under the provincial directly administered county system. The purpose of this paper is to construct a comprehensive and systematic supervision system of county-level government by discussing the supervision risk of county-level government directly under provincial control, so as to better realize the good development of county-level government. So that the provincial direct management of the county system reform more scientific and reasonable implementation.
