論教育正義的“善制”與“善治”

【摘要】:長(zhǎng)期以來(lái),我們一直試圖通過(guò)組織良好的制度安排來(lái)實(shí)現(xiàn)教育正義,然而,一個(gè)正義的教育制度,不僅是以善的價(jià)值精神為靈魂的制度,而且還是能夠流通于現(xiàn)實(shí)教育生活、直接成為治理教育現(xiàn)實(shí)的制度,善制內(nèi)在地要求善治。教育行政正義的目的在于實(shí)現(xiàn)善的教育治理。裁量是教育行政正義的最后環(huán)節(jié),它是面向現(xiàn)實(shí)世界的個(gè)案正義。裁量正義的實(shí)現(xiàn)既需要來(lái)自行政法規(guī)體系的外在制約,也需要教育行政官員的吏德建設(shè)。教育行政人員的美德精神使其在行為缺乏相應(yīng)的法律規(guī)定指導(dǎo)時(shí),仍可以求助于內(nèi)心的倫理指導(dǎo)準(zhǔn)則。
[Abstract]:For a long time, we have been trying to achieve educational justice through well-organized institutional arrangements. However, a just education system is not only a system with the spirit of good value as its soul, but also can circulate in real educational life. Directly become the system of governing the reality of education, good system requires good governance. The purpose of educational administrative justice is to achieve good educational governance. Discretion is the last link of educational administrative justice, and it is case justice facing the real world. The realization of discretion justice needs not only the external restriction from the system of administrative regulations, but also the construction of the officials' morality. The moral spirit of educating administrators makes them turn to the inner ethical guidelines when they lack the corresponding legal guidance.
