民辦幼兒園與地方教育行政機(jī)關(guān)關(guān)系的研究

【摘要】: 隨著辦學(xué)體制改革的深入,各類幼兒園不斷涌現(xiàn),幼兒教育的局面得到很大改 變,幼兒園數(shù)量增多,幼兒的入園率不斷增加,幼教事業(yè)逐漸形成了以民辦園為 主體、公辦園為龍頭的局面,但是由于我民辦幼兒園尚缺乏足夠的管理經(jīng)驗(yàn),導(dǎo) 致當(dāng)前民辦幼兒園存在諸多問(wèn)題,,尤其是中小城市表現(xiàn)突出。考慮到教育行政機(jī) 關(guān)是我國(guó)教育執(zhí)法最主要的主體,民辦幼兒園與教育行政部門的關(guān)系在很大程度 上決定幼兒教育體制的性質(zhì)與走向,因此建構(gòu)中小緘市中民辦幼兒園與教育行政 機(jī)關(guān)理想關(guān)系,在現(xiàn)實(shí)生活中尋找與之差距并提出相應(yīng)對(duì)策,應(yīng)是當(dāng)前促進(jìn)我國(guó) 幼兒教育事業(yè)規(guī)范發(fā)展的重要之舉。 基于以上考慮,本論文在結(jié)構(gòu)上分為五大部分: 緒論部分:根據(jù)當(dāng)前教育體制改革的社會(huì)背景,提出民辦幼兒園的出現(xiàn)有其必 然性和可行性,對(duì)民辦幼兒園的研究具有重要的現(xiàn)實(shí)意義。本論文主要采取理論 和社會(huì)調(diào)查相結(jié)合的研究方法,從法律法規(guī)的角度探討地方教育行政機(jī)關(guān)如何管 理民辦幼兒園。 第一章闡述了中外民辦幼兒園的發(fā)展歷程。我國(guó)民辦幼兒園的發(fā)展是以1949 年中國(guó)解放為分界嶺,具體闡述了不同時(shí)期的中國(guó)民辦幼兒園的發(fā)展,從而得出 結(jié)論:無(wú)論什么年代的民辦幼兒園都離不開政府的支持和管理。對(duì)于國(guó)外的民辦 幼兒園,本論文選擇了日本、美國(guó)和法國(guó)三國(guó)作為研究的內(nèi)容,最后總結(jié)出即使 國(guó)外的民辦幼兒園也不例外地需要政府的支持和管理。從而為中小城市民辦幼兒 園與地方教育行政機(jī)關(guān)關(guān)系的建構(gòu)奠定基礎(chǔ)。 第二章借鑒國(guó)外民辦幼兒園與地方教育行政機(jī)關(guān)的關(guān)系,根據(jù)中小城市的特 點(diǎn),闡述我國(guó)中小城市民辦幼兒園與地方教育行政機(jī)關(guān)的理想關(guān)系,是以政策法 規(guī)為導(dǎo)向的宏觀管理和以地方高校為基地的社會(huì)力量參與的關(guān)系。 第三章從法律法規(guī)的角度闡述現(xiàn)實(shí)生活中民辦幼兒園和地方教育行政機(jī)構(gòu)各 自的權(quán)利和義務(wù)。在這一部分里,本論文從應(yīng)然和實(shí)然兩個(gè)方面著手,具體闡述 了民辦幼兒園和地方教育行政機(jī)關(guān)應(yīng)然的權(quán)利和義務(wù),民辦幼兒園和地方教育行 政機(jī)關(guān)實(shí)然的權(quán)利和義務(wù),研究發(fā)現(xiàn)應(yīng)然和實(shí)然之間存在一定差距。通過(guò)分析得 出,以上四種權(quán)利和義務(wù)的錯(cuò)綜交織歸根結(jié)底實(shí)際上是權(quán)力與權(quán)利兩者之間的關(guān) 系,其中權(quán)力在整個(gè)關(guān)系的建構(gòu)中起著重要作用。 第四章著重闡述了地方教育行政機(jī)關(guān)管理民辦幼兒園的難為,并相應(yīng)提出了對(duì) 策以幫助建立二者之間的合理關(guān)系。地方教育行政機(jī)關(guān)權(quán)責(zé)難為主要表現(xiàn)在四個(gè) 方面:1、政策法規(guī)保障機(jī)制較弱 2、教育執(zhí)行者自身素質(zhì)欠缺 3、各行政部門溝 通不夠 4、責(zé)任追究機(jī)制還未建全,為此,需要從以下幾方面著手解決:1、增強(qiáng)教 育執(zhí)行者依法治教的觀念 2、制定地方性教育法規(guī),加強(qiáng)各部門的聯(lián)系 3、完善教 育執(zhí)法監(jiān)督,建立教育法律責(zé)任機(jī)制。 總之,本論文通過(guò)對(duì)民辦幼兒園歷史與現(xiàn)實(shí)的探討,從理論層面入手,結(jié)合相 關(guān)法律法規(guī),系統(tǒng)闡述了民辦幼兒園與地方教育行政機(jī)關(guān)的關(guān)系。
[Abstract]:With the deepening of the reform of school running system, various kindergartens are constantly emerging, and the situation of early childhood education has been greatly changed.
The number of kindergartens has increased, and the rate of kindergarten attendance has been increasing.
The main body is the situation of public parks, but my private kindergartens do not have enough management experience.
There are many problems in the current private kindergartens, especially in small and medium-sized cities.
Guan is the main body of education law enforcement in China, and the relationship between private kindergartens and educational administration departments is very large.
It determines the nature and trend of the early childhood education system, and constructs private kindergartens and educational administration in small and medium-sized cities.
The ideal relationship between organs and the gap between them in real life and the corresponding countermeasures should be promoted at present.
An important approach to the development of preschool education.
Based on the above considerations, the thesis is divided into five parts in structure.
Introduction: according to the social background of the current educational system reform, it is pointed out that the emergence of private kindergartens must have their own needs.
Nature and feasibility have important practical significance to the research of private kindergartens.
How to manage the local educational administration from the perspective of laws and regulations
A private kindergarten.
The first chapter expounds the development process of private kindergartens at home and abroad. The development of private kindergartens in China is based on 1949
China's liberation as a dividing line in 2004, specifically elaborated on the development of private kindergartens in different periods in China.
Conclusion: no matter what age private kindergartens are inseparable from the support and management of the government.

The foundation of the relationship between gardens and local educational administrative organs lay the foundation.
The second chapter draws lessons from the relationship between foreign private kindergartens and local educational administrative organs, according to the special features of small and medium-sized cities.
Point out that the ideal relationship between private kindergartens and local educational administrative organs in small and medium-sized cities in China is based on policy law.
The relationship between regulated macro management and the participation of social forces based on local colleges and universities.
In the third chapter, from the perspective of laws and regulations, it expounds the private kindergartens and local educational administrative organs in real life.
In this part, the thesis starts from two aspects: the ought to be and the reality.
The rights and obligations of private kindergartens and local educational administrative organs, private kindergartens and local educational institutions.
The actual rights and obligations of the political organs have found that there is a certain gap between the ought and the reality.
In the final analysis, the above four kinds of rights and obligations are actually intertwined between power and rights.
System, in which power plays an important role in the construction of the whole relationship.
The fourth chapter focuses on the difficulties of local educational administrative organs in managing private kindergartens, and puts forward corresponding suggestions.
In order to help to establish a reasonable relationship between the two, the local educational administrative organ's power and responsibility are mainly manifested in four aspects.
Aspects: 1, 2 are weak in policies and regulations, and 3 in educational administrators.
If there is not enough 4, the accountability mechanism has not yet been established. For this reason, we need to solve the following problems: 1, enhance teaching.
2, the concept of education by law enforcement practitioners according to law. The local education laws and regulations should be formulated, the links between departments should be strengthened 3, and teaching should be perfected.
The supervision of law enforcement and the establishment of the mechanism of legal responsibility for education are established.
In short, this paper discusses the history and reality of private kindergartens from the theoretical level.
The relationship between private kindergartens and local educational administrative organs is systematically expounded in accordance with laws and regulations.
