【摘要】：隨著全面建設小康社會總目標的不斷推進,人們生活水平日益提高,溫飽問題逐漸得到解決,“個人權(quán)益是否得以保障”逐漸上升到了人人關(guān)心的社會層面,尤其是涉及到個人切身利益的社會保障制度的設立、實施以及改革等問題都無一不引起國人的關(guān)注。隨著近年來醫(yī)鬧事件、掛號難事件、因病返貧困境等等一系列醫(yī)療問題的不斷涌現(xiàn),醫(yī)療改革已連續(xù)多年成為兩會熱點問題,緩解甚至解決這些醫(yī)療問題刻不容緩,在醫(yī)療改革過程中“保基本”的醫(yī)療保障制度發(fā)揮著無可替代的作用。改革醫(yī)療衛(wèi)生體系最重要的無疑是解決“由誰來提供醫(yī)療服務”和“由誰來支付醫(yī)療費用”這兩個問題,其中尤為重要的是解決“由誰來支付醫(yī)療費用”這一問題,這就需要發(fā)揮醫(yī)療保障制度的作用了。只有發(fā)揮出醫(yī)療保障制度應有的作用,才能實現(xiàn)使老百姓“有錢看病”的目標。然而,事實是我國醫(yī)療保障制度在實施過程中出現(xiàn)了許多問題,其中最突出的就是公平性問題,如果不能妥善地處理好我國醫(yī)療保障制度公平性問題,將不能發(fā)揮出它應有的作用。我國醫(yī)療保障制度公平性問題從制度設立之初就一直存在,針對如何解決這一問題不少專家學者從社會改革、經(jīng)濟建設、政府職能等各個方面給出了自己的看法,唯獨缺少從倫理的角度進行分析。任何制度都是需要理論支持,而羅爾斯“正義論”自發(fā)表之初就一直被認為是政治哲學和道德倫理學的重要著作,借鑒這一理論對指導醫(yī)療保障制度改革有重要意義。本文主要分為四個部分來探討我國醫(yī)療保障制度改革與羅爾斯正義論的關(guān)系。第一部分是前言部分,介紹本文的研究目的、研究意義以及研究現(xiàn)狀和創(chuàng)新點。第二部分是介紹羅爾斯正義論思想及簡要分析,通過對正義、公平、公正以及羅爾斯正義論思想主要內(nèi)容的分析,深化羅爾斯正義論的內(nèi)涵；再通過羅爾斯正義論思想與其他正義論思想的對比,說明我國醫(yī)療保障制度改革要借鑒羅爾斯義論思想的意義。第三部分是我國醫(yī)療保障制度現(xiàn)狀的分析,主要介紹我國醫(yī)療保障制度的歷史發(fā)展進程,以及發(fā)展過程中存在的倫理困境,并找出我國醫(yī)療保障制度出現(xiàn)的倫理困境的原因。第四部分是基于羅爾斯正義論的我國醫(yī)療保障制度的倫理思考。通過分析羅爾斯正義論的政治倫理內(nèi)涵,指出借鑒羅爾斯正義論倫理內(nèi)涵對我國醫(yī)療保障制度改革的倫理啟示。
[Abstract]:With the continuous advancement of the overall goal of building a well-off society in an all-round way, people's living standards are improving day by day, the problem of food and clothing is gradually solved, and whether the personal rights and interests are guaranteed has gradually risen to the social level that everyone cares about. In particular, the establishment, implementation and reform of the social security system, which involve personal interests, have attracted the attention of Chinese people. With the emergence of a series of medical problems in recent years, such as medical incidents, registered cases, and the plight of returning to poverty due to illness, medical reform has become a hot issue of the two sessions for many years, so it is urgent to alleviate or even solve these medical problems. In the process of medical reform, the basic medical security system plays an irreplaceable role. Undoubtedly, the most important thing in reforming the health care system is to solve the two problems of "who will provide medical services" and "who will pay for medical expenses", especially the issue of "who pays for medical expenses?" This needs to give play to the role of medical security system. Only by exerting the function of medical security system, can we realize the goal of making people have money to see a doctor. However, the fact is that there are many problems in the implementation of our medical security system, among which the most prominent one is fairness. If we cannot properly handle the fairness of our medical security system, Will not play its due role. The fairness of the medical security system in China has existed since the beginning of its establishment. Many experts and scholars have put forward their own views on how to solve this problem from the aspects of social reform, economic construction, government functions, etc. However, there is a lack of ethical analysis. Any institution needs theoretical support, but Rawls' theory of justice has been regarded as an important work of political philosophy and moral ethics since the beginning of its publication. It is of great significance to use this theory for reference in guiding the reform of medical security system. This paper is divided into four parts to discuss the relationship between the reform of medical security system and Rawls' theory of justice. The first part is the preface, which introduces the purpose, significance, research status and innovation of this paper. The second part is to introduce Rawls' theory of justice and brief analysis, through the analysis of justice, fairness, justice and the main content of Rawls' theory of justice, deepen the connotation of Rawls' theory of justice; Through the comparison between Rawls' theory of justice and other ideas of justice, the author points out that the reform of medical security system in our country should draw lessons from Rawls' theory of justice. The third part is the analysis of the current situation of the medical security system in our country, mainly introduces the historical development process of the medical security system of our country, as well as the ethical dilemma existing in the development process, and finds out the reasons for the ethical dilemma in the medical security system of our country. The fourth part is the ethical thinking of medical security system based on Rawls' theory of justice. By analyzing the political and ethical connotation of Rawls' theory of justice, the author points out that drawing lessons from the ethical connotation of Rawls' theory of justice can enlighten the reform of medical security system in China.
