【摘要】：當(dāng)前我國正處于由傳統(tǒng)社會向現(xiàn)代社會過渡的時期,社會工作者正是在新舊體制交替的時代背景下產(chǎn)生,經(jīng)過30多年的發(fā)展,社會工作者已經(jīng)成為社會主義現(xiàn)代化建設(shè)的一道亮麗的風(fēng)景線,是構(gòu)建社會主義和諧社會的重要推動力。然而,作為新生事物,社會工作者的發(fā)展還不盡如人意,常常遭遇尷尬和困境,這種尷尬產(chǎn)生的原因有：社會工作者的待遇不高,社會大眾對其認(rèn)識度和接受度低,還有社會工作者在崗位設(shè)置方面也存在缺陷。社會工作者在隊伍建設(shè)方面存在眾多問題,歸根結(jié)底在于我國社會工作者的立法不完善,具體表現(xiàn)在：關(guān)于社會工作者的立法數(shù)量少且法律效力低,“暫行”和“試行”現(xiàn)象嚴(yán)重；立法內(nèi)容方面還不完善,存在許多空白之處,比如：社會工作者的法律概念界定模糊,社會工作者的權(quán)利義務(wù)規(guī)定不對等,社會工作者的保障機制不夠健全等；另外,現(xiàn)行的社會工作者立法還不符合授權(quán)的規(guī)定。我國社會工作者在立法方面存在的這些問題,不利于社會工作者隊伍的建設(shè)。 為了打破這一困境,更好地保障我國社會工作者的合法權(quán)益,促進社會工作者服務(wù)事業(yè)的健康有序發(fā)展,我國必須加快對社會工作者法律法規(guī)的研究和制定。通過搜集大量的文獻資料,并結(jié)合國內(nèi)各地和域外地區(qū)社會工作者立法的現(xiàn)狀,綜合運用文獻分析法、理論分析法和對比分析法,針對我國社會工作者立法存在一些問題,提出如下建議：完善我國的社會工作者立法體系,制定一部統(tǒng)一的、專項的社會工作者的法律法規(guī),比如當(dāng)前我國應(yīng)該制定一部《社會工作者條例》,并在條例中明確社會工作者的內(nèi)涵和外延,明確社會工作者的權(quán)利和義務(wù),明確社會工作者的準(zhǔn)入條件,另外,還要對社會工作者的法律責(zé)任和權(quán)利救濟加以規(guī)定。

However, as a new thing the development of social workers, is not satisfactory, often encountered embarrassment and difficulties, the reason for this awkward: the social worker's salary is not high, the public understanding and acceptance of the low, there are defects and social workers in the post setting. There are many problems in the social worker team construction, after all is me the social worker's legislation is not perfect, specific performance in: the quantity of legislation on social workers and the legal effect is low, the "temporary The line "and" trial "phenomenon is serious; the contents of the legislation is not perfect, there are many gaps, such as: the legal concept of social workers defined the social worker's rights and obligations are not equal, safeguard mechanism of social workers is not perfect; in addition, the current social worker legislation also does not comply with the licensing rules. I our social workers exist in the legislation of these problems is not conducive to the construction of social workers.
In order to break through this dilemma, better protect our social worker's legitimate rights and interests, promote social worker service healthy and orderly development, China must accelerate the research and formulation of laws and regulations on social workers. By collecting literature, combined with the status quo of all over the country and outside areas of social workers legislation, comprehensive use the literature analysis, theoretical analysis and comparative analysis, according to the legislation of social worker has some problems, put forward the following suggestions: perfecting the legislation system of social workers, formulate a unified special laws and regulations, social workers, such as the current our country should establish a "social workers Ordinance, and clear the connotation and extension of social workers in the regulations, clearly the rights and obligations of social workers, social workers clear access conditions, in addition, also on the The legal responsibilities and rights relief of social workers are stipulated.
