【摘要】：《物權(quán)法》第六十條賦予了村民委員會代表農(nóng)民集體行使土地所有權(quán)的權(quán)利,在村民委員會強大的行政背景下,村民委員會的民事主體被行政主體身份吞噬,導致農(nóng)民集體土地所有權(quán)被其行政化行使的問題。法理分析和司法實證分析均證明農(nóng)民集體土地所有權(quán)被行政化行使問題的根源在于:現(xiàn)行法律制度的缺陷導致農(nóng)民集體和村集體經(jīng)濟組織在法律規(guī)定上的虛位。因此,必須從立法層面加以解決,將農(nóng)民集體土地所有權(quán)制度問題統(tǒng)一立法。
[Abstract]:Article 60 of the property Law gives the villagers' committee the right to exercise the ownership of the land on behalf of the peasants collectively. Under the strong administrative background of the villagers' committee, the civil subject of the villagers' committee is swallowed up by the status of the administrative subject. Leading to the farmers' collective land ownership by its administrative exercise of the problem. Both the legal analysis and the judicial empirical analysis prove that the root of the problem lies in: the defects of the current legal system lead to the fictitious position of the peasant collective and the village collective economic organization in the legal regulation. Therefore, must be solved from the legislative level, the farmer collective land ownership system unified legislation.
