【摘要】：隨著改革的深入，經(jīng)濟(jì)的快速發(fā)展，吸引更多的人口涌入城市。這給城市的發(fā)展在帶來新的活力的同時(shí)，也引發(fā)了很多新的矛盾和問題，例如，商販占道經(jīng)營、城市中亂建建筑、亂扔垃圾等，造成街道的臟亂差。這不僅干擾了城市的市民的正常生活，而且也影響了城市的良好發(fā)展環(huán)境。因此，為了確保城市的干凈有序的生活和良好的城市發(fā)展環(huán)境，緩解市民們之間的關(guān)于生存權(quán)利之間的矛盾，政府必須對(duì)城市的發(fā)展進(jìn)行管理。城管執(zhí)法部門雖然存在著各種問題，被社會(huì)大眾不解和辱。但是，，我們必須承認(rèn)它存在的必要性，城市的發(fā)展離不開它的執(zhí)法。 本文以十八屆三中全會(huì)的關(guān)于繼續(xù)深化行政執(zhí)法體制改革為背景，主要以聊城市的城市管理綜合行政執(zhí)法實(shí)踐為例，對(duì)我國的城市管理行政執(zhí)法的發(fā)展進(jìn)程以及城市管理執(zhí)法存在的正當(dāng)性進(jìn)行了闡述。并對(duì)城市管理執(zhí)法事件中存在的問題進(jìn)行了分析和研究，結(jié)合我國的城市管理經(jīng)驗(yàn)的基礎(chǔ)上，針對(duì)城市管理執(zhí)法在實(shí)踐中存在的問題進(jìn)行了完善。全文共分為三個(gè)部分。 第一部分對(duì)城管執(zhí)法的正當(dāng)性進(jìn)行了闡述。包括人們對(duì)城管執(zhí)法質(zhì)疑和以及我從事實(shí)和理論兩方面對(duì)城管執(zhí)法制度存在的合理性的論證。 第二部分以聊城市為例，分析了城管執(zhí)法取得發(fā)展和取得的成效以及城管執(zhí)法制度存在的主要問題和原因。 第三部分結(jié)合我國城管執(zhí)法的實(shí)際情況，借鑒國外的城市管理的經(jīng)驗(yàn)，圍繞城市管理執(zhí)法體制的完善、健全城管執(zhí)法的監(jiān)督體系、完善執(zhí)法部門與媒體的溝通以及妥善處理執(zhí)法部門和市民的關(guān)系進(jìn)行了論述。
[Abstract]:With the deepening of the reform and the rapid development of the economy, more people are attracted to the city. This brings new vitality to the development of the city, while it also causes a lot of new contradictions and problems, for example, the peddlers are engaged in the operation, the construction of the city is built, the garbage is thrown into the streets, which not only disturbs the city's citizens. In order to ensure a clean and orderly life of the city and a good environment for the development of the city, and to alleviate the contradictions between the citizens' right to live, the government must manage the development of the city. We must admit the necessity of its existence. The development of the city cannot be separated from its enforcement.
With the background of deepening the reform of the administrative law enforcement system in the third Plenary Session of the 18th CPC Central Committee, this paper mainly takes the practice of the comprehensive administrative law enforcement of urban management in Liaocheng as an example, and expounds the development process of administrative law enforcement in urban management and the legitimacy of the law enforcement of urban management in our country, and it also exists in the law enforcement events of urban management. The problem is analyzed and studied. On the basis of the experience of urban management in China, the problems existing in the practice of urban management law enforcement are perfected. The full text is divided into three parts.
The first part expounds the legitimacy of the law enforcement of urban management, including the question about the law enforcement of urban management and the reasonableness of the existence of the law enforcement system of urban management from the two sides of the facts and theories.
The second part takes Liaocheng as an example to analyze the development and achievements of urban management law enforcement and the main problems and reasons of urban management law enforcement system.
The third part, combining the actual situation of the city management law enforcement in our country, drawing on the experience of the city management in foreign countries, surrounding the perfection of the law enforcement system of urban management, perfecting the supervision system of the law enforcement of urban management, perfecting the communication between the law enforcement department and the media, and properly dealing with the relationship between the law enforcement department and the citizens.
