【摘要】：本文以突發(fā)環(huán)境事件應(yīng)急及立法的相關(guān)理論為切入點(diǎn)，系統(tǒng)梳理了我國(guó)突發(fā)環(huán)境事件應(yīng)急的立法現(xiàn)狀，分析了其中存在的主要問(wèn)題，考察了國(guó)外有關(guān)國(guó)家突發(fā)環(huán)境事件應(yīng)急立法的概況并對(duì)其先進(jìn)經(jīng)驗(yàn)進(jìn)行了總結(jié)。在此基礎(chǔ)上，緊扣國(guó)內(nèi)立法中存在的主要問(wèn)題，積極借鑒國(guó)外有益經(jīng)驗(yàn)，從原則、立法體系和法律制度等方面對(duì)我國(guó)突發(fā)環(huán)境事件應(yīng)急立法提出了完善對(duì)策。文章除導(dǎo)論和結(jié)語(yǔ)外，主要分為以下四章： 第一章：突發(fā)環(huán)境事件應(yīng)急的概述。從基本理論的角度闡述了突發(fā)環(huán)境事件的概念、特征和危害以及突發(fā)環(huán)境事件產(chǎn)生的原因；對(duì)突發(fā)事件應(yīng)急、突發(fā)環(huán)境事件應(yīng)急的概念及其應(yīng)急機(jī)制進(jìn)行了分析，為深入研究突發(fā)環(huán)境事件應(yīng)急的立法奠定了基礎(chǔ)。 第二章：我國(guó)突發(fā)環(huán)境事件應(yīng)急立法現(xiàn)狀與問(wèn)題分析。以立法體系理論為方法，，主要從憲法層面、法律層面、行政法規(guī)層面、地方法規(guī)規(guī)章及部門(mén)規(guī)章等方面分析了我國(guó)突發(fā)環(huán)境事件應(yīng)急立法的現(xiàn)狀，并提出了各個(gè)層面對(duì)立法國(guó)存在的主要問(wèn)題與不足。 第三章：國(guó)外突發(fā)環(huán)境事件應(yīng)急立法的經(jīng)驗(yàn)借鑒。介紹了國(guó)外在突發(fā)環(huán)境事件應(yīng)急立法方面的經(jīng)驗(yàn)以及給我國(guó)帶來(lái)的啟示，主要分析了美國(guó)、日本、俄羅斯、德國(guó)等國(guó)家關(guān)于突發(fā)環(huán)境事件立法的概況及相關(guān)經(jīng)驗(yàn)，對(duì)其進(jìn)行分析和總結(jié)，并從完善應(yīng)急立法體系、建立健全應(yīng)急管理組織機(jī)構(gòu)、完善相關(guān)應(yīng)急制度措施等方面提出了對(duì)我國(guó)的啟示和借鑒。 第四章：我國(guó)突發(fā)環(huán)境事件應(yīng)急立法的完善。從立法原則的完善、立法體系的完善和相關(guān)制度的完善提出了完善對(duì)策。突發(fā)環(huán)境事件應(yīng)急立法完善的原則包括合法性原則、效率原則、風(fēng)險(xiǎn)預(yù)防原則、協(xié)調(diào)原則、比例原則、科學(xué)原則；立法體系的完善主要從憲法、法律、法規(guī)規(guī)章和政策等方面提出了意見(jiàn)；相關(guān)制度的完善分為事前預(yù)防階段的相關(guān)法律制度完善、事中處置階段相關(guān)法律制度完善、事后恢復(fù)階段相關(guān)法律制度。
[Abstract]:Based on the relevant theories of environmental emergency and legislation, this paper systematically combs the current situation of emergency legislation in China, and analyzes the main problems in it. The general situation of emergency legislation in foreign countries is reviewed and its advanced experience is summarized. On this basis, the main problems existing in the domestic legislation are closely followed, the beneficial experience of foreign countries is actively used for reference, and the countermeasures are put forward from the aspects of principle, legislative system and legal system to improve the emergency legislation of unexpected environmental events in China. In addition to the introduction and conclusion, the article is divided into the following four chapters: the first chapter: an overview of environmental emergencies. From the angle of basic theory, this paper expounds the concept, characteristics and hazards of environmental emergencies and the causes of environmental emergencies, and analyzes the concepts and mechanisms of emergencies, environmental emergencies and emergency. It lays a foundation for further research on emergency legislation of environmental emergencies. Chapter two: the current situation and problems of emergency legislation in China. Based on the theory of legislative system, this paper analyzes the current situation of emergency legislation of environmental emergencies in China from the aspects of constitution, law, administrative regulations, local regulations and departmental regulations, etc. At the same time, it puts forward the main problems and shortcomings of the opposite France at various levels. Chapter three: the experience of emergency legislation in foreign countries. This paper introduces the experience of foreign countries in emergency legislation of environmental emergencies and its enlightenment to our country. It mainly analyzes the general situation and relevant experience of the legislation on environmental emergencies in the United States, Japan, Russia, Germany and other countries, such as the United States, Japan, Russia, Germany and other countries. From the aspects of perfecting the emergency legislation system, establishing and perfecting the organization of emergency management, and perfecting the relevant measures of emergency system, this paper puts forward the enlightenment and reference to our country from the aspects of improving the emergency legislation system, establishing and perfecting the emergency management organization, and perfecting the relevant emergency system measures. Chapter four: the perfection of emergency legislation in China. The countermeasures are put forward from the perfection of legislative principles, legislative system and related systems. The principles of legislation perfection include legality principle, efficiency principle, risk prevention principle, coordination principle, proportion principle, scientific principle. The related system is divided into three parts: the related legal system in the prevention stage, the related legal system in the disposal stage, and the relevant legal system in the recovery stage.
