貴州省農(nóng)地法律保護問題研究

【摘要】：保有適量的農(nóng)地是關(guān)系到人類生存發(fā)展、國家經(jīng)濟和社會可持續(xù)的全局性戰(zhàn)略問題。國家歷來重視農(nóng)地問題,始終將農(nóng)地保護的問題放在政府工作的重心來抓。但隨著國家經(jīng)濟的發(fā)展,在經(jīng)濟增長的大背景下,有時會選擇忽視農(nóng)地的利益從而保證經(jīng)濟的高速增長,城鎮(zhèn)化步伐的加快,亦會使得農(nóng)地的經(jīng)濟效益、社會效益、生態(tài)效益的減少或消失。近年來,隨著貴州省經(jīng)濟進入高速增長期,且貴州長期存在的農(nóng)地石漠化,政府農(nóng)地保護觀念滯后,農(nóng)民對農(nóng)地保護意識不強等多方因素制約,農(nóng)地保護的矛盾就顯得日益尖銳,盡管貴州省也采取了一定的農(nóng)地保護措施,但農(nóng)地數(shù)量仍在持續(xù)減少,并引發(fā)了質(zhì)量下降、生態(tài)破壞等一系列問題。針對于貴州省目前在農(nóng)地保護中所存在的問題,必須在充分了解實際情況、找出產(chǎn)生問題根源的基礎(chǔ)之上,構(gòu)建與完善貴州省的農(nóng)地保護綜合體系。本研究正是基于這一目的,從貴州農(nóng)地保護的實際情況出發(fā),分析了處理經(jīng)濟發(fā)展與農(nóng)地保護之間如何平衡的問題,即貴州省在高速的發(fā)展之下,農(nóng)地的數(shù)量逐年下降、高質(zhì)量的農(nóng)地日趨減少、生態(tài)環(huán)境遭到破壞,同時也適當參考了國內(nèi)外在農(nóng)地保護方面的經(jīng)驗,通過從農(nóng)地征收標準的確立、石漠化治理、農(nóng)地保護激勵機制的建立、健全相關(guān)農(nóng)地保護法律體系以及完善司法保障機制等幾個方面提出了我國農(nóng)地保護體系的建設(shè)思路。本文分三部分,共三萬多字。第一部分先對農(nóng)地的定義、價值和保護意義進行闡述。第二部分從貴州省農(nóng)地總體形勢入手,運用適量的理論依據(jù)及實際數(shù)據(jù)客觀分析了當前貴州省農(nóng)地保護中存在的問題,進而明確了加強貴州省農(nóng)地保護的必要性。針對貴州省農(nóng)地數(shù)量減少、質(zhì)量下降,生態(tài)環(huán)境遭到損害的客觀形勢和后果,結(jié)合貴州省農(nóng)地法律保護現(xiàn)狀與實踐,著重闡述了貴州省農(nóng)地保護存在的,農(nóng)地保護激勵機制缺失、法律法規(guī)體系不健全、司法保障不完善等問題。第三部分通過總結(jié)現(xiàn)有農(nóng)地保護經(jīng)驗,針對貴州省土地保護存在的問題,提出了構(gòu)建與完善貴州省農(nóng)地保護體系的建議。通過結(jié)合貴州省自身的實際狀況,具體提出明確征收標準,嚴格農(nóng)地非農(nóng)化用途的審批,針對貴州農(nóng)地最突出的石漠化問題,給出了相關(guān)建議。對于農(nóng)地保護的激勵機制構(gòu)建上,明確了激勵機制的相關(guān)主體、獎勵標準的確定、資金的來源、補償金的管理等具體框架。構(gòu)建以土地保護法律體系與相關(guān)法律制度為主,補充與完善地方性法規(guī)上位法、加強貴州省土地保護地方性立法的方針。同時,綜合運用司法保障公民訴訟權(quán)利,對農(nóng)地執(zhí)法主體進行監(jiān)督等多種手段,構(gòu)建適合貴州省農(nóng)地法律保護的長效機制。
[Abstract]:Keeping the right amount of farmland is an overall strategic problem related to the survival and development of human beings and the national economic and social sustainability. The state has always attached importance to the issue of agricultural land and has always focused on the protection of agricultural land in the work of the government. However, with the development of the national economy, under the background of economic growth, sometimes the interests of agricultural land will be ignored to ensure the rapid economic growth and the acceleration of urbanization, which will also make the economic and social benefits of agricultural land. The reduction or disappearance of ecological benefits. In recent years, with Guizhou's economy entering a period of rapid growth, and Guizhou's long-term agricultural land rocky desertification, the government's concept of farmland protection lags behind, farmers' awareness of farmland protection is not strong and other factors, such as constraints. The contradiction of farmland protection is becoming more and more sharp. Although Guizhou Province has also taken some measures to protect farmland, the quantity of farmland is still decreasing, and has caused a series of problems, such as quality decline, ecological destruction and so on. In view of the existing problems in farmland protection in Guizhou province, it is necessary to construct and perfect the comprehensive system of farmland protection in Guizhou province on the basis of fully understanding the actual situation and finding out the root causes of the problems. This study is based on this purpose, from the actual situation of farmland protection in Guizhou Province, this paper analyzes how to balance the economic development and farmland protection, that is, under the rapid development of Guizhou Province, the number of agricultural land is decreasing year by year. The high quality farmland is decreasing day by day and the ecological environment has been destroyed. At the same time, it also makes proper reference to the experience of farmland protection at home and abroad, through the establishment of the standard of farmland expropriation, the control of rocky desertification, and the establishment of incentive mechanism for farmland protection. The author puts forward the construction ideas of farmland protection system in China from several aspects, such as perfecting the legal system of farmland protection and perfecting the judicial safeguard mechanism. This article is divided into three parts, a total of more than 30,000 words. The first part expounds the definition, value and protection significance of farmland. The second part, starting with the general situation of agricultural land in Guizhou Province, analyzes the problems existing in the protection of agricultural land in Guizhou Province by using appropriate theoretical basis and practical data, and then clarifies the necessity of strengthening the protection of agricultural land in Guizhou Province. In view of the objective situation and consequences of the decrease in the quantity and quality of agricultural land and the damage to the ecological environment in Guizhou Province, combined with the present situation and practice of the legal protection of agricultural land in Guizhou Province, the paper emphatically expounds the existence of agricultural land protection in Guizhou Province. Lack of incentive mechanism of farmland protection, imperfect system of laws and regulations, imperfect judicial guarantee and so on. In the third part, through summing up the existing experience of farmland protection, aiming at the existing problems of land protection in Guizhou province, the author puts forward some suggestions on how to construct and perfect the farmland protection system in Guizhou province. According to the actual situation of Guizhou Province, this paper puts forward a clear standard of expropriation and strict examination and approval of agricultural land for non-agricultural use, and puts forward some relevant suggestions in view of the most prominent problem of rocky desertification of agricultural land in Guizhou Province. As to the construction of incentive mechanism of farmland protection, the relevant main body of incentive mechanism, the determination of reward standard, the source of funds, the management of compensation fund and so on are defined. Based on the legal system of land protection and related legal system, this paper aims to supplement and perfect the local laws and regulations, and strengthen the local legislation of land protection in Guizhou Province. At the same time, comprehensive use of judicial protection of civil litigation rights, the main supervision of farmland law enforcement and other means to build a long-term mechanism suitable for the legal protection of agricultural land in Guizhou Province.
