我國公共租賃住房法律制度研究

【摘要】:公共租賃住房,現(xiàn)今已經(jīng)成為保障性住房體系中最為重要的組成部分。它關系著人民生活以及國家經(jīng)濟社會的穩(wěn)定。隨著經(jīng)濟的發(fā)展很多地區(qū)出現(xiàn)了“夾心層”群體,他們的住房保障問題也逐漸成為了社會的熱點問題,F(xiàn)階段學術界對于公共租賃住房的理論研究主要在于社會學與經(jīng)濟學層面,較少從法學的角度進行系統(tǒng)的闡述,對于公共租賃住房制度的政策和法律問題也研究較少。因此本文以公共租賃住房制度國內(nèi)外政策為基礎,對我國公共租賃住房法律制度進行理論研究。 首先本文介紹公共租賃住房制度研究的背景及其意義,然后對公共租賃住房制度進行概述并對于公共租賃住房制度的歷史沿革問題進行深入的研究,,希望可以從歷史的角度具體闡述公共租賃住房制度在是我國是如何演變與發(fā)展的。接下來是公共租賃住房制度的法學理論基礎研究。主要包括三部分內(nèi)容。首先是對于公共租賃住房制度的憲法理論基礎,包括對于憲法中住宅權的分析以及用公民的基本權利為視角進行分析,為公共租賃住房制度找到憲法依據(jù)和理論支撐點。其次是對公共租賃住房制度進行經(jīng)濟法的分析,最后是對公共租賃住房的社會法基礎理論進行分析。 第四部分是本文的重點。主要是對公共租賃住房制度的國內(nèi)外考察。首先是國外考察部分,這里介紹了發(fā)達國家公共租賃住房制度的特點并試圖找出我國可以借鑒之處。第二部分是對公共租賃住房制度的國內(nèi)考察。筆者對于政策規(guī)定較為完善的北京市與天津市進行全面分析全面考察,通過對國內(nèi)的公共租賃住房制度考察提出該制度在我國政策中存在的問題與不足,最后是我國公共租賃住房制度的完善。主要針對該制度存在的問題做出有針對性的完善建議。從政策的角度、從權利與投資主體角度、從法律管理監(jiān)督的角度、從規(guī)劃建設與配套設施的角度入手分析,在各個層面提出筆者相關的完善建議,最終實現(xiàn)發(fā)展我國公共租賃住房制度的目的,盡快實現(xiàn)居民“住有所居”,構建社會和諧。
[Abstract]:Public rental housing, now has become the most important part of the affordable housing system. It is related to the life of the people and the stability of the country's economy and society. With the development of economy, sandwiched groups appear in many areas, and their housing security has gradually become a hot issue in the society. At present, the theoretical research of public rental housing in academia mainly lies in sociology and economics, less systematic elaboration from the perspective of law, and less research on the policy and legal issues of public rental housing system. Therefore, based on the domestic and foreign policies of public rental housing system, this paper makes a theoretical study on the legal system of public rental housing in China. First of all, this paper introduces the background and significance of the public rental housing system, then summarizes the public rental housing system and makes a deep research on the historical evolution of the public rental housing system. It is hoped that the evolution and development of public rental housing system in China can be expounded from the perspective of history. Next is the legal theoretical basis of the public rental housing system. It mainly includes three parts. The first is the constitutional theoretical basis of the public rental housing system, including the analysis of the right to housing in the constitution and the basic rights of citizens as the perspective of analysis, for the public rental housing system to find the constitutional basis and theoretical support. Secondly, it analyzes the economic law of public rental housing system, and finally analyzes the basic theory of social law of public rental housing. The fourth part is the focus of this paper. Mainly to the public rental housing system at home and abroad. First of all, it introduces the characteristics of public rental housing system in developed countries and tries to find out what we can learn from it. The second part is the domestic investigation of the public rental housing system. The author makes a comprehensive analysis of Beijing and Tianjin, which have perfect policies and regulations, and puts forward the problems and shortcomings of this system in our policy through the investigation of the domestic public rental housing system. Finally is our country public rental housing system consummation. Mainly aimed at the existing problems of the system to make targeted recommendations for improvement. From the angle of policy, from the angle of rights and investment subjects, from the angle of legal management and supervision, from the angle of planning, construction and supporting facilities, the author puts forward the relevant suggestions for perfection at all levels. Finally realize the aim of developing the public rental housing system of our country, realize the resident "living and living" as soon as possible, construct the social harmony.
