語(yǔ)義學(xué)方法與法律詞匯學(xué)習(xí)

法律專業(yè)的學(xué)生不僅要學(xué)習(xí)大量的案例,法規(guī)和法理,還必須學(xué)習(xí)法律語(yǔ)言。而在法律語(yǔ)言中,各種行話、習(xí)語(yǔ)、古語(yǔ)、外來(lái)詞比比皆是,即使對(duì)于法律承載語(yǔ)為本族語(yǔ)的學(xué)習(xí)者來(lái)講,法律語(yǔ)言都堪稱為一門外語(yǔ),而對(duì)于以第二語(yǔ)言為媒介來(lái)學(xué)習(xí)法律的學(xué)習(xí)者來(lái)講更是晦澀難懂,無(wú)怪乎學(xué)習(xí)者在學(xué)習(xí)過(guò)程中大多面臨著巨大的困難。為了幫助法律英語(yǔ)的學(xué)習(xí)者在一定程度上克服這一困難,掌握一定的學(xué)習(xí)者策略,本文擬通過(guò)對(duì)語(yǔ)義學(xué)方法的一些介紹,提供一種學(xué)習(xí)法律英語(yǔ)的有效途徑,即語(yǔ)義學(xué)的途徑。 本文分為五個(gè)章節(jié)。第一章主要闡述了法律和語(yǔ)言的關(guān)系,指出語(yǔ)言對(duì)于法律的關(guān)鍵性作用。此外,本章就國(guó)內(nèi)外學(xué)界對(duì)語(yǔ)言和法律關(guān)系的研究進(jìn)行了一個(gè)簡(jiǎn)要的綜述,簡(jiǎn)要介紹了部分影響較大的學(xué)者和其著作,并指出了其很少涉及本文論題,即把與圖示法相結(jié)合的語(yǔ)義學(xué)方法作為一種法律學(xué)習(xí)者策略,從而論述了本文寫作的實(shí)際意義。 第二章回顧了本文將要應(yīng)用的語(yǔ)義學(xué)理論的研究狀況,它首先概述了語(yǔ)義成分分析法,并對(duì)該語(yǔ)義學(xué)方法的研究歷史進(jìn)行了介紹,同時(shí)還通過(guò)實(shí)例解釋了該方法的具體內(nèi)容。本文接著介紹了語(yǔ)義場(chǎng)理論的發(fā)展史,特別談到了語(yǔ)義場(chǎng)理論的先行者特里爾和他提出的幾個(gè)原則和該理論的優(yōu)缺點(diǎn)。接下來(lái)的部分主要討論了語(yǔ)義關(guān)系以其分類,提到了三種基本關(guān)系類別:近義,反義和上下義。第四部分討論了語(yǔ)義場(chǎng)的五大特征,即層級(jí)性,交叉性,相對(duì)性,可變性和民族性。本章最后一部分提及到了圖示法對(duì)詞匯學(xué)習(xí)的助益,主張把圖示法和語(yǔ)義學(xué)理論結(jié)合起來(lái)運(yùn)用到詞匯學(xué)習(xí)中去。 第三章著重介紹了學(xué)習(xí)策略理論,列舉了部分學(xué)界對(duì)學(xué)習(xí)者策略研究歷史和現(xiàn)狀,學(xué)習(xí)者策略的定義,討論了該理論的特點(diǎn),和其對(duì)實(shí)踐的指導(dǎo)作用,提出教授者應(yīng)該向?qū)W習(xí)者傳授學(xué)習(xí)策略以達(dá)到事半功倍的效果。 第四章主要討論了如何通過(guò)上述語(yǔ)義學(xué)理論和方法來(lái)確定法律詞匯詞義和擴(kuò)大法律詞匯量。本章首先區(qū)別了同義詞的普通意義和法律意義,接著介紹了如何用成分分析法來(lái)區(qū)分法律詞匯中的近義詞和反義詞,指出法律學(xué)習(xí)者可以通過(guò)分析近義詞組和反義詞組的語(yǔ)義成分來(lái)深入理解法律條文的精髓。本章還建議適用語(yǔ)義場(chǎng)作為法律詞匯積累的手段。本章的最后部分結(jié)合科恩的策略教學(xué)五步法提出了進(jìn)行法律詞匯教學(xué)的方法,并設(shè)計(jì)了部分練習(xí)。 第五章得出結(jié)論,語(yǔ)義學(xué)方法是一種有效的學(xué)習(xí)策略,能在一定程度上輔助學(xué)習(xí)者對(duì)法律詞匯的學(xué)習(xí)。同時(shí)提出了值得進(jìn)一步研究的一些問(wèn)題。
