【摘要】：近年來(lái)以康菲漏油、湖南瀏陽(yáng)鎘污染、紫金礦業(yè)銅酸水滲漏等為代表的一系列環(huán)境污染事故的發(fā)生,不僅造成嚴(yán)重的生態(tài)環(huán)境污染和破壞,也影響了當(dāng)?shù)厝藗兊恼�常生�?甚至危害到了群眾的生命、健康、財(cái)產(chǎn)安全,因此凸顯出環(huán)境保護(hù)在當(dāng)前的社會(huì)生活中的重要意義。環(huán)境保護(hù)應(yīng)成為全社會(huì)的共識(shí),光靠政府、企業(yè)的單薄力量是不夠的,需要全體公眾一起行動(dòng)參與其中來(lái)維護(hù)環(huán)境公共利益。如此一來(lái)確立環(huán)境公益訴訟就顯得尤為重要了。意大利羅馬法學(xué)者彼得羅.彭梵得認(rèn)為,“為維護(hù)公共利益而設(shè)置的罰金訴訟為民眾訴訟,任何市民都有權(quán)提起它�！本吞崞鸸�益訴訟方面,環(huán)保NGO與其他主體相比具有獨(dú)特的優(yōu)勢(shì)地位,但目前尚存在著不足,如何解決這些不足并充分發(fā)揮自身優(yōu)勢(shì),關(guān)系到環(huán)境公益訴訟的良性運(yùn)轉(zhuǎn)。 目前,我國(guó)云南、貴州、江蘇等地結(jié)合現(xiàn)實(shí)情況的需要,相繼成立環(huán)境資源保護(hù)審判庭,但是這些環(huán)保法庭成立后,卻遭遇了“門庭冷落”的境遇,究其根源還是由于我國(guó)缺乏完善的環(huán)境公益訴訟制度,而環(huán)境公益訴訟原告資格問(wèn)題則是環(huán)境公益訴訟制度的關(guān)鍵問(wèn)題,對(duì)其加以深入研究,從而構(gòu)建完善的環(huán)境公益訴訟原告體系,有效保護(hù)人類共同的環(huán)境公益訴訟原告體系,有效保護(hù)人類共同的環(huán)境利益。 鑒于此,本文試圖通過(guò)對(duì)我國(guó)環(huán)保NGO在環(huán)境公益訴訟中的現(xiàn)實(shí)困境分析,并指出其存在的問(wèn)題。為解決這一問(wèn)題,分別借鑒了以美國(guó)為代表的英美法系、以德國(guó)為代表的大陸法系國(guó)家中對(duì)環(huán)保NGO的實(shí)踐經(jīng)驗(yàn),并作了比較分析,以提出我國(guó)可借鑒的經(jīng)驗(yàn)?zāi)Ｊ?形成較強(qiáng)可行性、適合我國(guó)國(guó)情的環(huán)保NGO的環(huán)境公益訴訟原告資格制度,改善我國(guó)環(huán)境公共利益遭受侵害或可能遭受侵害時(shí),得不到及時(shí)、有效救濟(jì)的狀況,以發(fā)揮環(huán)保NGO的社會(huì)功能,解決我國(guó)環(huán)境問(wèn)題,以實(shí)現(xiàn)我國(guó)社會(huì)主義生態(tài)文明,塑造美麗中國(guó)。
[Abstract]:In recent years, a series of environmental pollution accidents, such as ConocoPhillips oil spill, cadmium pollution in Liuyang, Hunan Province, and copper acid water leakage in Zijin mining industry, have occurred, which not only caused serious ecological pollution and damage, but also affected the normal life of local people. It even endangers the lives, health and property safety of the masses. Therefore, it highlights the importance of environmental protection in the current social life. Environmental protection should become the consensus of the whole society. It is not enough to rely solely on the weak power of the government and enterprises. All the public need to act together to protect the environmental public interest. So it is especially important to establish the environmental public interest litigation. According to Italian Roman law scholar Petrov Penfandt, "in order to protect the public interest," And the fine action set up is a public action. Any citizen has the right to file it. "in terms of public interest litigation, environmental protection NGO has a unique advantage status compared with other subjects, but there are still shortcomings, how to solve these deficiencies and give full play to its own advantages," he said. Related to the benign operation of environmental public interest litigation. At present, Yunnan, Guizhou, Jiangsu and other places in China have set up environmental and resource protection courts one after another in the light of the needs of the actual situation. However, after the establishment of these environmental protection courts, they have encountered a situation of "cold shoulder". The reason is the lack of perfect environmental public interest litigation system in our country, and the qualification of plaintiff in environmental public interest litigation is the key issue of environmental public interest litigation system. In order to build a perfect plaintiff system of environmental public interest litigation, effectively protect the common environmental public interest litigation plaintiff system, and effectively protect the common environmental interests of mankind. In view of this, this paper attempts to analyze the practical predicament of environmental protection NGO in environmental public interest litigation in China, and points out the existing problems. In order to solve this problem, the paper draws lessons from the Anglo-American legal system, which is represented by the United States, respectively. The practical experience of environmental protection NGO in civil law countries, represented by Germany, is compared and analyzed in order to put forward the experience model that can be used for reference in our country to form a strong feasibility. The environmental public interest litigation plaintiff qualification system of environmental protection NGO, which is suitable for our country's national conditions, can not get timely and effective relief when the environmental public interest is infringed or may be infringed, so as to give play to the social function of environmental protection NGO. To solve the environmental problems in order to realize our socialist ecological civilization and shape the beautiful China.
