【摘要】：農(nóng)村宅基地是農(nóng)村土地的重要組成部分,是農(nóng)村農(nóng)民特有的一種保障。農(nóng)村宅基地使用權(quán)是在農(nóng)村土地之上建造農(nóng)房的權(quán)利,它屬于我國物權(quán)法體系中一個特有的概念,也就是說,宅基地使用權(quán)是我國農(nóng)民特有的一種權(quán)利。我國《土地管理法》第62條有以下規(guī)定：農(nóng)民家庭每戶只能審批使用一處本村集體所有的宅基地,而且,如果農(nóng)民將他的宅基地出租、出賣或者贈與他人使用,而自己再申請宅基地的,將不予批準(zhǔn)。這也就意味著,農(nóng)村宅基地的初始登記是非常重要的管理宅基地的一個方法,也為高效利用土地資源,維護(hù)農(nóng)民切身利益提供了重要保障作用。然而,目前,在農(nóng)村宅基地使用權(quán)初始登記過程中,還存在著許多問題。本論文就是以舟山市為例,針對在宅基地登記的實(shí)踐中存在的具體問題,尋找解決辦法,為減少農(nóng)村宅基地登記中的糾紛提供一定的借鑒作用。筆者主要從以下四個方面來加以闡述：第一部分,關(guān)于研究背景、研究意義的闡述,對相關(guān)概念加以界定,并結(jié)合國內(nèi)研究綜述,指出本論文的研究目的、研究方法；第二部分,以舟山市普陀區(qū)為例,介紹舟山市農(nóng)村宅基地使用權(quán)登記的現(xiàn)狀；第三部分,.結(jié)合實(shí)例提出舟山市普陀區(qū)宅基地使用權(quán)登記中存在的問題；第四部分,就如何解決舟山市普陀區(qū)宅基地登記存在的具體問題提出相應(yīng)的對策。在研究中發(fā)現(xiàn),舟山宅基地使用權(quán)登記中存在以下幾個問題。宅基地使用權(quán)登記規(guī)范體系不夠完備、缺乏登記簿制度、沒有建立登記機(jī)構(gòu)的賠償責(zé)任機(jī)制、土地登記機(jī)構(gòu)人員素質(zhì)不高等。為解決這些問題,提出了以下相關(guān)建議：首先要完善宅基地使用權(quán)登記規(guī)范體系。第二要建立土地登記簿制度。第三要建立宅基地登記賠償機(jī)制。第四要提升登記機(jī)構(gòu)從業(yè)人員的素質(zhì)。
[Abstract]:Rural homestead is an important part of rural land, is a kind of special safeguard farmers in rural areas. Rural land use right is to build houses in rural land on the right, it is a special concept of real law system in our country, that is to say, land use right is a kind of special rights in China farmers. China's "land management law > sixty-second has the following provisions: farmer households can only be approved land use, a village collective and farmers, if his land rent, sell or use their gifts to others, and to apply for the fund, will not be approved. This means the initial registration of Rural Homestead, is a very important method of homestead management, but also for the efficient use of land resources, provides an important guarantee to safeguard the vital interests of farmers. However, at present, the right to use homestead in rural areas Initial registration process, there are still many problems. This paper is taking Zhoushan city as an example, according to the practical problems in the registration of homestead in the search for solutions to provide certain reference for reducing rural homestead registration disputes. The author mainly from four aspects to be explained: the first part of the research background, research significance, defining the related concepts, combined with the domestic research review, points out the research purpose, the research methods; the second part, taking Zhoushan city of Putuo District as an example, introduces the status quo of Zhoushan rural homestead use right registration; the third part, combined with examples of Zhoushan. Putuo District City land use right registration problems; the fourth part, put forward the corresponding countermeasures on how to solve the specific problems of Zhoushan City, Putuo District homestead registration exists. In the study. Now, Zhoushan land use right registration. There are several problems in the land use right registration system is not perfect, the lack of register system, have not established the mechanism of liability registration, land registration agency personnel quality is not high. In order to solve these problems, put forward the following suggestions: first registration system right the use of perfect homestead. The second is to establish land registry system. Third to establish a homestead registration compensation mechanism. Fourth to improve the quality of personnel registration agencies.
