【摘要】：獲得戶口登記直接涉及個(gè)人人格和身份應(yīng)獲保障的基本人權(quán),而"黑戶"問題的存在使得很多公民的這項(xiàng)權(quán)利得不到有效保障。造成"黑戶"問題的主要原因既與戶口制度本身的性質(zhì)有關(guān),更與地方政府為戶口登記設(shè)置不合理?xiàng)l件存在莫大關(guān)系;同時(shí),政策治理模式也導(dǎo)致了治理"黑戶"問題的實(shí)際效果非常不理想。2016年國務(wù)院辦公廳發(fā)布的《關(guān)于解決無戶口人員登記戶口問題的意見》對于提高我國人權(quán)保障水平具有重要意義。但是,要徹底解決"黑戶"問題,還有必要在戶口登記制度中引入人權(quán)視角,通過修訂《戶口登記條例》進(jìn)一步提高戶口制度的法治化水平。
[Abstract]:The acquisition of household registration is directly related to the fundamental human rights that the personality and identity of an individual should be safeguarded, However, the existence of the problem of "household registration without registration" has left many citizens without effective protection of this right. The main reason for the problem of "household registration without registration" is related to the nature of the hukou system itself. There is also a great deal of relationship between the unreasonable conditions set by local governments for household registration; at the same time, The policy governance model has also led to a very unsatisfactory actual effect on the problem of "household registration without registration". In 2016, the General Office of the State Council issued the "opinions on solving the problem of registered hukou without hukou" for improving the protection of human rights in China. Equality is important. But, In order to solve the problem of "household registration without registration", it is necessary to introduce a human rights perspective into the household registration system, and to further improve the rule of law level of the household registration system by revising the regulations of household registration.
