【摘要】：耕地為農(nóng)業(yè)發(fā)展之基,農(nóng)業(yè)為農(nóng)民生存之本�，F(xiàn)階段,我國耕地保護(hù)的威脅來自農(nóng)地非農(nóng)化,其中最主要的是土地征收。我國耕地征收補(bǔ)償制度大體上較為完備,但仍存在一定的缺陷:補(bǔ)償主體缺位而致使村委會借機(jī)侵害農(nóng)民集體產(chǎn)權(quán),補(bǔ)償標(biāo)準(zhǔn)受到揚(yáng)公抑私思想的影響而未允許失地農(nóng)民享有土地增值的收益,補(bǔ)償程序粗疏而未能發(fā)揮程序?qū)��?shí)體權(quán)利保障的功能,補(bǔ)償方式單一而未能為農(nóng)民的長遠(yuǎn)發(fā)展提供機(jī)遇。因而在耕地征收補(bǔ)償制度的重構(gòu)過程中,明晰補(bǔ)償主體是治本之策,"市場價(jià)格補(bǔ)償+稅收調(diào)節(jié)"是關(guān)鍵舉措,發(fā)揮程序的利益整合功能是輔助措施,綜合運(yùn)用多種補(bǔ)償方式是長久之計(jì)。提高征收補(bǔ)償?shù)臉?biāo)準(zhǔn)是保護(hù)資源的一種有效方法。
[Abstract]:Cultivated land is the basis of agricultural development and agriculture is the foundation of farmers' survival. At present, the threat of farmland protection in China comes from the conversion of agricultural land, the most important of which is land expropriation. However, there are still some defects: the absence of compensation subject causes the village committee to take advantage of the opportunity to infringe on the collective property rights of farmers, and the compensation standard is affected by the idea of promoting public control over private property without allowing land-losing farmers to enjoy the benefit of land increment. The compensation procedure is careless and fails to play the function of procedural protection of substantive rights, and the compensation method is single and fails to provide opportunities for the long-term development of farmers. Therefore, in the process of reconstructing the system of expropriation and compensation of cultivated land, Clarifying the main body of compensation is the fundamental strategy, "market price compensation tax regulation" is the key measure, and giving full play to the function of interest integration of the procedure is the auxiliary measure. Comprehensive use of multiple compensation methods is a long-term solution. Raising the standard of expropriation and compensation is an effective way to protect resources.
