【摘要】：中國的經(jīng)濟改革已經(jīng)進行了30余年,全國各地在公用事業(yè)的改革上做了許多的嘗試,以求達到一方面保證公用事業(yè)單位不斷提高經(jīng)濟效益,另一方面又要確保公眾利益得到保障。為了達到上述目的,公用事業(yè)改革的一個重點是公用事業(yè)民營化。然而民營化在實踐中取得成效的同時,也凸顯了一些不足,因而制定具有可操作性的法律法規(guī),建立和完善我國的公用事業(yè)民營化的法律制度已成當務(wù)之急。本文正是基于改變與完善我國公用事業(yè)立法滯后于經(jīng)濟發(fā)展現(xiàn)狀的迫切需要,綜合運用分析、比較、歸納等研究方法,主要討論了公用事業(yè)民營化法律規(guī)制的問題。首先,主要從公用事業(yè)的概念、特點、范圍及公用事業(yè)民營化的法律概念、背景入手,對其進行分析,對公用事業(yè)民營化的相關(guān)內(nèi)容進行了概述；其次,通過對我國公用事業(yè)民營化經(jīng)營體制改革的歷史進程及法律體系的分析,從中可以摸索出我國公用事業(yè)經(jīng)營體制改革過程的特點；然后,在探討我國公用事業(yè)民營化的立法理論和實踐概況的基礎(chǔ)上,得出我國目前在相關(guān)方面的法律現(xiàn)狀以及存在的相關(guān)的法律問題；接著通過對比國外發(fā)達國家在公用事業(yè)民營化方面的立法現(xiàn)狀,總結(jié)出其值得我國借鑒的先進理念及經(jīng)驗；最后,第五部分在總結(jié)全文的基礎(chǔ)上,提出了構(gòu)建和完善我國公用事業(yè)民營化的法律規(guī)制的幾點建議。試圖從理論上對公用事業(yè)民營化進行相關(guān)的探討,以期其能更好地發(fā)揮其應有的作用,實現(xiàn)公用事業(yè)的良性發(fā)展。
[Abstract]:China's economic reform has been going on for more than 30 years, and many attempts have been made in various parts of the country on the reform of public utilities in order to achieve, on the one hand, to ensure that public utilities will continuously improve their economic efficiency. On the other hand, it is necessary to ensure that public interests are protected. In order to achieve the above purpose, one of the key points of the reform of public utilities is the privatization of public utilities. However, while privatization has achieved results in practice, it has also highlighted some shortcomings. Therefore, it is urgent to formulate workable laws and regulations and to establish and perfect the legal system of privatization of public utilities in our country. This paper is based on the urgent need to change and perfect the legislation of public utilities in China, which lags behind the current economic development. Through comprehensive analysis, comparison, induction and other research methods, this paper mainly discusses the legal regulation of privatization of public utilities. First of all, it starts with the concept, characteristics, scope, legal concept and background of privatization of public utilities. Secondly, through the analysis of the historical process and legal system of the privatization management system of public utilities in China, the related contents of privatization of public utilities are summarized. Then, on the basis of discussing the legislative theory and practice of the privatization of public utilities in our country, we can find out the characteristics of the reform process of the management system of public utilities in China. Then, by comparing the legislation status of foreign developed countries in the privatization of public utilities, the author summarizes the advanced ideas and experiences that our country can learn from. Finally, on the basis of summing up the full text, the fifth part puts forward some suggestions on how to construct and perfect the legal regulation of privatization of public utilities in China. With a view to its better play its due role, to achieve the benign development of public utilities.
