物業(yè)管理政府監(jiān)管法律問題研究

【摘要】:改革開放以來,經(jīng)濟(jì)迅猛發(fā)展使居民的收入不斷提高。以收入的不斷提高為基礎(chǔ),居民對居住條件的需求也在不斷的提升,強(qiáng)勢的市場需求推動下,房地產(chǎn)行業(yè)也迅猛發(fā)展。隨著房地產(chǎn)行業(yè)的飛速發(fā)展,作為提升居住品質(zhì)重要方面的物業(yè)管理被從國外引入。物業(yè)管理行業(yè)方興未艾,潛力巨大。作為物業(yè)管理后發(fā)國家,我國相關(guān)制度存在著一定的缺失。立法上,以《中華人民共和國物權(quán)法》(以下簡稱《物權(quán)法》)為基礎(chǔ);以《物業(yè)管理?xiàng)l例》為支撐;以各省、市、自治區(qū)、直轄市的相關(guān)地方性法規(guī)和政府規(guī)章為補(bǔ)充,物業(yè)管理法律制度初步形成,這對物業(yè)管理行業(yè)意義非凡。但上述法律、法規(guī)略失之于寬泛,已不能完全適應(yīng)物業(yè)管理的現(xiàn)狀。隨著物業(yè)管理行業(yè)的不斷發(fā)展,物業(yè)管理法律、法規(guī)漸漸難以適應(yīng)物業(yè)管理行業(yè)的快速發(fā)展,而市場的自我調(diào)節(jié)又有其固有缺陷,物業(yè)管理行業(yè)是保障民生的一個重要方面,政府監(jiān)管是十分必要的。本文運(yùn)用實(shí)證分析法、比較分析法等研究方法對實(shí)踐中物業(yè)管理政府監(jiān)管中的法律問題進(jìn)行分析,并試著提出一些具有參考意義的法律對策。本文主要分為四大部分:第一部分:介紹物業(yè)管理的起源、發(fā)展和含義及物業(yè)管理政府監(jiān)管的含義及特征,并闡述本文的理論基礎(chǔ)。首先介紹了物業(yè)管理的起源、發(fā)展以及在我國的發(fā)展,并簡要介紹物業(yè)管理的含義;然后從行政法的角度對物業(yè)管理政府監(jiān)管的含義以及其特征進(jìn)行了介紹;最后闡述了本文的理論基礎(chǔ)。理論基礎(chǔ)主要分為兩部分,第一是法學(xué)理論基礎(chǔ),主要是行政法的服務(wù)論;第二是經(jīng)濟(jì)學(xué)理論基礎(chǔ),主要是政府干預(yù)理論。第二部分:分析物業(yè)管理制度的現(xiàn)狀。對物業(yè)管理政府監(jiān)管法律制度的現(xiàn)狀,從立法現(xiàn)狀、實(shí)踐現(xiàn)狀兩個方面進(jìn)行分析。第三部分:分析物業(yè)管理制度存在的問題及法律成因。對存在的問題及導(dǎo)致問題出現(xiàn)的法律上的成因進(jìn)行了探討。第四部分:提出法律上的對策與建議。針對物業(yè)管理政府監(jiān)管中存在的問題,從法律角度提出相應(yīng)的對策與建議。本文在法律的視角下對物業(yè)管理政府監(jiān)管現(xiàn)狀進(jìn)行分析,并對如何協(xié)調(diào)政府、業(yè)主、物業(yè)管理企業(yè)三者之間的關(guān)系進(jìn)行了探討。
[Abstract]:Since the reform and opening up, the rapid development of the economy has led to the continuous improvement of residents' income. Based on the continuous improvement of income, the demand for living conditions of residents is also constantly improving, driven by the strong market demand, the real estate industry is also developing rapidly. With the rapid development of real estate industry, property management, as an important aspect of improving living quality, has been introduced from abroad. The property management industry is in the ascendant and has great potential. As a property management latecomer country, there are some deficiencies in the relevant systems in our country. In terms of legislation, it is based on the property Law of the people's Republic of China (hereinafter referred to as the property Law), supported by the property Management regulations, and based on the property Law of the people's Republic of China (hereinafter referred to as the property Law). Supplemented by the relevant local laws and regulations of provinces, cities, autonomous regions and municipalities directly under the Central Government, the legal system of property management has been initially formed, which is of great significance to the property management industry. However, the above laws and regulations are slightly broad and can no longer fully adapt to the current situation of property management. With the continuous development of the property management industry, it is gradually difficult for property management laws and regulations to adapt to the rapid development of the property management industry, and the self-regulation of the market has its inherent defects. The property management industry is an important aspect of ensuring people's livelihood. Government supervision is very necessary. This paper analyzes the legal problems in the supervision of property management government by means of empirical analysis, comparative analysis and other research methods, and tries to put forward some legal countermeasures with reference significance. This paper is divided into four parts: the first part: introduces the origin, development and meaning of property management and the meaning and characteristics of property management government supervision, and expounds the theoretical basis of this paper. This paper first introduces the origin, development and development of property management in our country, and briefly introduces the meaning of property management, and then introduces the meaning and characteristics of property management government supervision from the perspective of administrative law. Finally, the theoretical basis of this paper is expounded. The theoretical basis is mainly divided into two parts: the first is the theoretical basis of law, mainly the service theory of administrative law; the second is the theoretical basis of economics, mainly the theory of government intervention. The second part: analysis of the current situation of property management system. This paper analyzes the present situation of the legal system of property management government supervision from two aspects: the present situation of legislation and the present situation of practice. The third part: analysis of the problems existing in the property management system and legal causes. This paper probes into the existing problems and the legal causes of the problems. The fourth part: put forward the legal countermeasures and suggestions. In view of the problems existing in the government supervision of property management, this paper puts forward some corresponding countermeasures and suggestions from the legal point of view. This paper analyzes the present situation of property management government supervision from the perspective of law, and discusses how to coordinate the relationship among the government, owners and property management enterprises.
