中國(guó)金融轉(zhuǎn)型秩序的制度分析

【摘要】:金融轉(zhuǎn)型是經(jīng)濟(jì)轉(zhuǎn)型的核心構(gòu)成內(nèi)容和發(fā)展保障。但現(xiàn)實(shí)中,金融發(fā)展相對(duì)滯后、金融失序和無(wú)序現(xiàn)象時(shí)有發(fā)生、金融功能發(fā)揮不足,其結(jié)果,給市場(chǎng)經(jīng)濟(jì)的發(fā)展造成嚴(yán)重阻礙。基于此,有必要探討金融轉(zhuǎn)型秩序型構(gòu)問(wèn)題,探究其影響因素、作用機(jī)理、現(xiàn)實(shí)障礙以及破解對(duì)策,以期推動(dòng)金融轉(zhuǎn)型目標(biāo)實(shí)現(xiàn)、促進(jìn)經(jīng)濟(jì)深化發(fā)展。本文以制度分析方法為基本研究方法,沿著“理論分析——實(shí)踐反思——完善創(chuàng)新”的思路進(jìn)行研究。在對(duì)金融轉(zhuǎn)型秩序決定因素理論闡釋和現(xiàn)實(shí)狀況客觀評(píng)價(jià)基礎(chǔ)上,考慮金融日新月異發(fā)展、金融全球化國(guó)際化的背景,系統(tǒng)梳理金融發(fā)展、新制度經(jīng)濟(jì)學(xué)的相關(guān)理論,從模仿與創(chuàng)新、歷史與現(xiàn)代等角度,對(duì)已經(jīng)形成的金融制度、金融文化和制度環(huán)境三維框架加以全面認(rèn)真審視,探討它們對(duì)于秩序型構(gòu)的作用機(jī)制,挖掘根源,層層遞進(jìn),對(duì)中國(guó)金融制度創(chuàng)新中的理論與實(shí)踐問(wèn)題作出解答。我國(guó)進(jìn)行金融轉(zhuǎn)型是符合生產(chǎn)關(guān)系一定要適合生產(chǎn)力發(fā)展?fàn)顩r的規(guī)律和金融深化要求的,也是實(shí)現(xiàn)經(jīng)濟(jì)改革目標(biāo)的基本途徑。金融轉(zhuǎn)型總體目標(biāo)是要由計(jì)劃金融向市場(chǎng)金融、封閉金融向開(kāi)放金融、傳統(tǒng)金融向現(xiàn)代金融轉(zhuǎn)型,最終實(shí)現(xiàn)金融結(jié)構(gòu)體系合理、各子系統(tǒng)協(xié)調(diào)有序、穩(wěn)定發(fā)展、公平競(jìng)爭(zhēng)的秩序型構(gòu)目標(biāo)。轉(zhuǎn)型期,我國(guó)金融運(yùn)行與發(fā)展秩序與最終目標(biāo)存在差距,它不利于金融深化目標(biāo)實(shí)現(xiàn)。如何改變金融轉(zhuǎn)型過(guò)程中的失序狀態(tài)?理論上,金融結(jié)構(gòu)體系、信任基礎(chǔ)、正式制度、金融文化、政治經(jīng)濟(jì)體制、市場(chǎng)環(huán)境等因素均會(huì)對(duì)金融秩序產(chǎn)生影響,但制度是秩序型構(gòu)的決定因素。它能夠約束政府防止權(quán)力濫用、約束平等經(jīng)濟(jì)主體維護(hù)公平競(jìng)爭(zhēng)、提供信息形成穩(wěn)定預(yù)期、促進(jìn)合作建立良好秩序。由此,失序狀態(tài)的解決要著眼于制度創(chuàng)新。我國(guó)金融制度供求狀況與變遷特點(diǎn)影響轉(zhuǎn)型秩序型構(gòu)。政府主導(dǎo)的金融制度供給存在供給缺乏適應(yīng)性的缺點(diǎn),這會(huì)造成金融供給不能滿足需求的困境。供求非均衡下的強(qiáng)制性制度變遷不能完全破解困境。其結(jié)果,既得利益者易陷入金融尋租腐敗,而缺乏制度支持的需求者在現(xiàn)實(shí)利益的驅(qū)使下則有可能突破制度約束鋌而走險(xiǎn),誘發(fā)金融失序。不僅如此,我國(guó)金融契約、產(chǎn)權(quán)制度不成熟、金融主體行為規(guī)則不完善、政府與市場(chǎng)關(guān)系不明晰,這些均會(huì)給我國(guó)金融交易秩序、競(jìng)爭(zhēng)秩序與管控秩序的型構(gòu)帶來(lái)阻礙。為此,轉(zhuǎn)軌國(guó)家要不斷解決此問(wèn)題。除了上述正式制度外,價(jià)值信念、倫理規(guī)范等非正式制度也會(huì)對(duì)金融秩序型構(gòu)產(chǎn)生影響。轉(zhuǎn)型期,計(jì)劃經(jīng)濟(jì)的思維、制度與舉措尚未退出國(guó)家權(quán)力與社會(huì)運(yùn)行空間,市場(chǎng)經(jīng)濟(jì)思維、制度尚在建構(gòu)中。這種情況下,非正式制度的穩(wěn)定性被打破,非正式規(guī)則易出現(xiàn)變形扭曲,對(duì)新秩序型構(gòu)產(chǎn)生阻滯作用。金融轉(zhuǎn)型是一個(gè)系統(tǒng)工程,它還需要特定的制度環(huán)境以保障各項(xiàng)制度的實(shí)施。目前我國(guó)金融轉(zhuǎn)型面臨著比較嚴(yán)峻的法律環(huán)境、體制環(huán)境和市場(chǎng)環(huán)境,它對(duì)制度保障和秩序型構(gòu)帶來(lái)制約。未來(lái),我國(guó)金融制度要在正式制度、非正式制度和制度環(huán)境三個(gè)層面謀求供給創(chuàng)新。正式制度供給創(chuàng)新的總體思路:借助地方政府力量,發(fā)展中間擴(kuò)散型制度創(chuàng)新模式;樹(shù)立金融制度服務(wù)實(shí)體經(jīng)濟(jì)功能觀,回歸制度本源;加強(qiáng)民營(yíng)、外資和地方性金融制度供給,夯實(shí)制度需求主體。具體的金融制度供給創(chuàng)新對(duì)策是:構(gòu)筑金融產(chǎn)權(quán)制度,提升金融組織績(jī)效;保障金融契約履行,穩(wěn)固金融交易基礎(chǔ);改革金融主體進(jìn)出與運(yùn)營(yíng)制度,保障金融競(jìng)爭(zhēng)秩序;創(chuàng)新金融管控制度,解鎖金融壓制體制;完善金融市場(chǎng)中介組織制度,彌補(bǔ)市場(chǎng)與政府失靈。非正式制度供給創(chuàng)新的總體思路:構(gòu)建有利于促進(jìn)非正式制度完善的制度保障機(jī)制;樹(shù)立與市場(chǎng)經(jīng)濟(jì)相適應(yīng)的金融價(jià)值觀,發(fā)揮意識(shí)形態(tài)引導(dǎo)作用;培育夯實(shí)金融文化基礎(chǔ)。制度環(huán)境優(yōu)化層面,第一要著眼于金融立法、執(zhí)法、司法三個(gè)方面優(yōu)化法律環(huán)境。第二促成政治體制和經(jīng)濟(jì)體制相輔相成、共同發(fā)展優(yōu)化體制環(huán)境。最后要優(yōu)化市場(chǎng)環(huán)境。金融轉(zhuǎn)型秩序型構(gòu)中,制度環(huán)境、正式制度與非正式制度三者合力作用發(fā)揮極其必要。因此,要夯實(shí)制度環(huán)境基礎(chǔ),發(fā)揮好制度環(huán)境支持力作用;要理性建構(gòu)正式制度,減少與非正式制度的摩擦;還要加強(qiáng)非正式制度與正式制度的融合,保障正式制度實(shí)施。惟有三者相輔相成,才能推動(dòng)金融轉(zhuǎn)型秩序型構(gòu)目標(biāo)順利實(shí)現(xiàn)。

In the transition period , the financial system of our country is not mature , the financial subject ' s behavior rules are not perfect , and the government and the market relationship are not perfect . In the future , the financial system of our country faces a severe legal environment , the system environment and the market environment .

Strengthening the supply of private , foreign and local financial systems and tamping the system demand subject . The specific financial system supply and innovation countermeasure is to construct the financial property right system and improve the financial organizational performance ;
Guarantee the performance of financial contract and stabilize the foundation of financial transaction ;
Reform the system of entry and exit and operation of the financial subject and guarantee the financial competition order ;
To innovate the financial control system and unlock the financial repression system ;
Perfect the system of financial market intermediary organizations , make up the market and the government failure . The general idea of the informal system supply innovation : to construct the system safeguard mechanism which is beneficial to promote the consummation of the informal system ;
Set up the financial values that are compatible with the market economy and play an ideological guidance role ;
In order to optimize the market environment , the system environment , the formal system and the informal system play an extremely important role .
To rationally construct formal system , reduce the friction with the informal system ;
It is necessary to strengthen the integration of the informal system and the formal system and guarantee the implementation of the formal system . Only the three mutually reinforce each other in order to promote the smooth realization of the constitutive goals of the financial transformation order .
