【摘要】：語(yǔ)料庫(kù)被更多的應(yīng)用于應(yīng)用語(yǔ)言學(xué)的各項(xiàng)研究中,而基于語(yǔ)料庫(kù)的法律翻譯研究是一個(gè)新話題,語(yǔ)料庫(kù)是法律翻譯研究很方便的工具,因?yàn)樗�有�?qiáng)大的檢索和統(tǒng)計(jì)功能。本文主要對(duì)中國(guó)法律法規(guī)漢英平行語(yǔ)料庫(kù)的部分詞匯翻譯進(jìn)行了探索和研究。中國(guó)法律法規(guī)漢英平行語(yǔ)料庫(kù)是一個(gè)漢英雙語(yǔ)平行語(yǔ)料庫(kù),里面一共包含了我國(guó)234部法律和其英語(yǔ)譯文。本文根據(jù)前人陳忠誠(chéng)、金朝武等人的論述,對(duì)一些翻譯可能錯(cuò)誤的詞語(yǔ)進(jìn)行了研究,重點(diǎn)對(duì)譯名不統(tǒng)一、詞匯翻譯不當(dāng)、近義詞翻譯混淆、詞匯翻譯語(yǔ)義韻沖突四類問題進(jìn)行了探討,在參照語(yǔ)料庫(kù)中進(jìn)行相應(yīng)的語(yǔ)言調(diào)查,分析翻譯不恰當(dāng)?shù)脑~語(yǔ)并探究其原因。研究發(fā)現(xiàn):中國(guó)法律法規(guī)漢英平行語(yǔ)料庫(kù)中詞語(yǔ)的的翻譯確實(shí)存在問題:1.一些術(shù)語(yǔ)的翻譯并不是一一對(duì)應(yīng)的,有些翻譯前后不統(tǒng)一,出現(xiàn)了一詞多譯的情況2.有些詞語(yǔ)的翻譯不夠準(zhǔn)確,有些出現(xiàn)了搭配沖突3.有些近義詞的翻譯互相混淆,普通意義的近義詞在法律語(yǔ)言中意思相差甚遠(yuǎn),不能混淆4.譯者忽略了詞語(yǔ)的語(yǔ)義韻,導(dǎo)致了語(yǔ)義韻沖突。最后,本文分析了詞語(yǔ)翻譯不當(dāng)問題背后的原因,并對(duì)如何減少法律詞語(yǔ)翻譯錯(cuò)誤或提供法律詞語(yǔ)翻譯質(zhì)量,使其表達(dá)更符合英語(yǔ)習(xí)慣,提出了改進(jìn)建議。筆者通過對(duì)法律詞匯翻譯漢英研究,發(fā)現(xiàn)譯者在翻譯的時(shí)候,規(guī)范性和統(tǒng)一性的意識(shí)很薄弱。在本文的第四章,筆者根據(jù)我國(guó)法律詞匯英譯出現(xiàn)的這些問題,結(jié)合前人的研究,提出了一些建議:法律術(shù)語(yǔ)的譯名需要專門的機(jī)構(gòu)來(lái)進(jìn)行審定,進(jìn)行標(biāo)準(zhǔn)化和規(guī)范化;法律翻譯需要由專業(yè)人員來(lái)進(jìn)行;法律詞語(yǔ)漢英詞典的編纂應(yīng)受到重視;建立專業(yè)、權(quán)威的法律詞語(yǔ)語(yǔ)料庫(kù)供大家使用。
[Abstract]:Corpus is more and more used in the research of applied linguistics, and corpus-based legal translation is a new topic. Corpus is a convenient tool for legal translation research because it has powerful retrieval and statistical functions. This paper mainly explores and studies the translation of some words in the Chinese-English parallel corpus of laws and regulations. Chinese laws and regulations Chinese-English parallel Corpus is a bilingual Chinese-English parallel corpus, which contains 234 Chinese laws and their English translations. Based on the discussion of Chen Zhongcheng and Jin Chaowu, this paper makes a study of some words which may be wrong in translation, focusing on the disunity of the translated names, the improper translation of words and the confusion in the translation of synonyms. This paper discusses four types of semantic conflicts in lexical translation, makes a corresponding language survey in the reference corpus, analyzes the improper translation of words and probes into their causes. It is found that there are some problems in the translation of words in the Chinese-English parallel corpus of laws and regulations: 1. The translation of some terms is not one-to-one, some of them are not uniform before and after translation, and there is a situation of multiple translation of one word. Some words have not been translated accurately, some have appeared collocation conflict 3. The translation of some synonyms is confused with each other. The meaning of synonyms of common meaning is very different in legal language and cannot be confused. The translator neglects the semantic rhyme of the word, which leads to the conflict of the semantic rhyme. Finally, this paper analyzes the reasons behind the improper translation of words, and puts forward some suggestions on how to reduce the errors in translation of legal words or to provide the quality of translation of legal words in order to make their expressions more in line with English habits. By studying the translation of legal vocabulary into Chinese and English, the author finds that the translator's consciousness of standardization and unity in translation is very weak. In the fourth chapter, according to these problems in the translation of legal vocabulary in our country, combined with the previous research, the author puts forward some suggestions: the translation of legal terms requires special institutions to carry on the examination and approval, to carry on the standardization and the standardization; Legal translation should be carried out by professionals, the compilation of Chinese-English dictionaries of legal words should be paid attention to, and a professional and authoritative corpus of legal words should be set up for everyone to use.
